A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING A VARIANCE. (VARIANCE NO. 971)

WHEREAS, the City Planning Commission of the City of Ana-
reoeive a petition from the prope~ty owner ..~~.P
of certain real property situated in the City of
Oounty of Orange, State of California, described as followSl
Anahe im,
Lot 29 of Tract No. 403, in the County of Orange,
State of Califb rnia, as per map recorded in Book
16, Page 11 of Miscellaneous Maps in the Office of
the County Recorder of said County;
EXCEPT the northerly 36 feet.
(Said property is located on the south side of Lincoln
Avenue between Harding and Western Aves.)
AND WHEREAS, the City Planning Commission did hold a pub-
lic hearing at the City Hall in the City of Anaheim upon said peti-
tion on May 19 1958 , notices of which said publio
hearings were dufy given as required by law and the provisions of
Seotion 9200.17 of the Anaheim Munioipal Code; and
WHEREAS, said Commission, after due inspeotion, investiga-
tion and studies made by itself and in its behalf and after due
consideration of all evidenoe and reports offered at said hearing,
did adopt its Resolution No. 267 ,recommending to the City Coun-
cil of the Oity of Anaheim that Variance No., 97,1 1 be granted upon
the conditions stated in said resolution; ~
WHEREAS, the City Council does find that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the prope~ty
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the pre-
servation and enjoyment of a substantial property
right possessed by other property in the same
vicinity and zone and denied to the property in
question.

,. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in suoh
vioinity and zone in which the property is located.
4. That the granting of such variance will not ad-
versely affect the comprehensive general zoning
plan.
NOW THEREFORE, BE IT RESOLVED by the City Counoil of the
City of Anaheim that a oonditional zoning variance be, and the
same is hereby granted to HENRY N. STOUT, 101 Stanton Avenue,
Anaheim, California, to erect a store building on the property
hereinabove described, subject to the following conditions:

1. That said building be constructed in accordance
with the plans presented to the City Council and
on file with the City of Anaheim.
2. That all engineering requirements of the City of
Anaheim on Lincoln Avenue, such as curbs and gutters,
sidewalks, street grading and paving, drainage
facilities or other pertinent wor}(, be complied with
as required by the City Engineer.
3. That the applicant or owner of the property improve
that portion of the alley at the rear of subJect
property when required to do so by the City
Engineer.

The City Council hereby reserves the right to revoke such
variance permit for good cause or failure of said owner his()eo~
heirs, successors or assigns, to comply with the Anahei~unicipal
Code and regulations and the conditions herein. Said variance is
granted for the term prescribed by the Anaheim Municipal Code unless
otherwise speoified herein.
