RESOLUTION NO. 4572
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING A VARIANCE. (AMENDED
VARIANCE NO. 823)
WHEREAS, the City Planning Commission of the City of Ana-
heim did receive a petition from the property owner ..&~..
of certain real property situated in the City of
Anaheim, County of Orange, State of California, described as follows:
Commencing at a point 8 feet easterly of the center line of
South Citron Street and 363 feet at right angles to the center
line of West Vermont Avenue, thence Southerly along this line
a distance of 420 feet; thence northwesterly following along
the right-of-way line of the Santa Ana Freeway a distance of
473 feet, more or less; thence easterly parallel to the
southerly right-of-way line of West Vermont Avenue a distance
of 215 feet to the point of beginning.
AND WHEREAS, the City Planning Commission did hold a pub-
lic hearing at the City Hall in the City of Anaheim upon said peti-
tion on April 7. 1958 , notices of which said public
hearings were duly given as required by law and the provisions of
Section 9200.17 of the Anaheim Municipal Code; and
WHEREAS, said Commission, after due inspection, investiga-
tion and studies made by itself and in its behalf and after due
consideration of all evidence and reports offered at said hearing,
did adopt its Resolution No. 220 ,recommending to the City Coun-
cil of the City of Anaheim that Variance No. 823 be granted upon
the conditions stated in said resolution; and
WHEREAS, the City Council does find that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the pre-
servation and enjoyment of a substantial property
right possessed by other property in the same
vicinity and zone and denied to the property in
question.
). That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
4. That the granting of such variance will not ad-
versely affect the comprehensive general zoning
plan.
NOW THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that a conditional zoning variance be, and the
same is hereby granted to LOUIS HENNIG, 200 South Los Angeles
Street, Anaheim, California, to erect a modern AUTOMOBILE SERVICE
PLANT upon the property hereinabove described, subject to the
following conditions:

1. That all buiJ.dings be erected in accordaJlce with the plot plan sub-
mitted to the City Council and on file with the City of Anahclm.
2. That the areas in front of the buildings and next to the Santa
Ana freeway be landscaped. .
3. That this variance is contingent upon the land to the north of sub-
ject property, owned by Louis Hennig, being zoned R-3, Multiple-
family Residential, and if and when changed to R-3, the placing of
record of standard City of Anaheim R-3 Deed Restrictions covering
the area.
4. That the owner of subject property place of record standard City
of Anaheim M-l, Light Manufacturing Zone, deed restrictions ap-
proved by the City Attorney.
S. That a masonry wall six (6) feet in height be constructed on the
east side of subject property when the adjoining property is
developed.
6. That the hours of ~~Nltion of said automobile service plant shall
be from 7 :00 A.M. ~o.7~OO P.M.
The City Counc~~y reserves the right to revoke such
variance permit for good cause or failure of said owner,his~~~
heirs, successors or assigns, to comply with the Anaheim Municipal
Code and regulations and the conditions herein. Said variance is
granted for the term prescribed by the Anaheim Municipal Code unless
otherwise specified herein.
