58R-4570 - R!SOLUT ION NO. 4570 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ART!CLE IX~ CHAPTER 2 OP THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SA 10 CHANGE OF ZONE $ . WHEREAS~ the City Planning Commission of the City of Ana.. heim has heretofore duly passed and adopted a resolution declaring its intention to change the boundaries of the zone or zones hereIn... arter mentioned and d.scribed and did fix a time and place for the holding of a public h.aring thereon in the manner and a. prescribed In Article IXp Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public hearing to consider said proposed change of zone or zonesp and did receive evidence and reports from persons Int.r.sted thereinj and WHEREAS, within a period of forty (40) days following the rinal hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and r..lons ror recommending an amendment to said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the boundaries of the zone hereinafter mentioned and described) and WHEREASg upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the 3rd day of June , 19 S8 g as the time and the Council ~amber In the City Hall of the City of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code) and WHEREASg at the time and place fixed for said public hear- ing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did thereupon con- sider the recommendations of the City Planning Commission) and WHEREAS, the City Council does tind and determine that the property and area proposed to be changed from the zone In which it is now tltuated to a different zone, as hereinafter set forth, i. more luitable for the zone or zones to which it is proposed to change .aid property and area and that the inclusion of said property and are. in such new zone or zones will increase the value ot said property and area and will not depreciate the values ot property in adjoining zones. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orangeg State of California, described as fOllOWS, to wit: That portion of that certain 15.86 acre parcel of land shown on a map thereof recorded in Book 40, Page 6 of Records of Survey in the Office of the Recorder of Orange County, Cali- fornia, described as follows: Beginning at the northwest corner of said parcel and running thence south 890~~'OO" east along the northerly line of said parcel 527.40 feet; thence south 0021'20" east parallel with the west line of said parcel 313.37 feet to an angle point in the south line of said parcel; thence north 89044'0011 west along said south line 527.40 feet to the west line of said parcel; -1- . -J - ,,-. thence North 0021'2011 west 313037 feet along said west line to the point of beginning; ALSO, that certain 17.63 acre parcel of land shown on a map thereof recorded in Book 40, Page 6 of Records of Survey in the Office of the Recorder of Orange County, Cali~rnia, EXCEPT the easterly 330 feet there- of, said 330 feet being as measured along the south line of said parcel, and which is the portion of the property described in Resolution No. 4555 upon which action by the City Council was deferred for a period of one week, be changed from R-A, RESIDENTIAL- AGRICULTURAL ZONE, to R-3, MULTIPLE-FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That any multiple-family residential buildings con- structed on the lots on the north portion of subject property abutting on R-l, Single-Family Residential lots, shall be restricted to one story in height. 2. That the owner of subject property place of record standard City of Anaheim R-3 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the height of any multiple-family residential dwellings constructed on the lots on the north portion of subject property abutting on R-l lots, to one story. 3. That any single-story multiple family reSidential units constructed on subject property shall be of similar architectural character to the two-story multiple famtly structures included in the plans submitted to the City Council, on file with the City and made a part of Application No. F-57-58-49. 4. That provision be made for a right-of-way for the proposed flood control channel. 5. That the owner of subject property pay to the City of Anaheim the sum of $25.00 per lot for the acquisition of park and recreation sites. 6. That the final subdivision map, in which subject property is included, be recorded within a period of six (6) months from date hereof, unless con- ditions beyond the control of the subdivider prohibit his filing the same. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Munici- pal Code to accomplish the object herein found and de- termined to be necessary and proper.
