58R-4556 - RESOLUTION NO. h5S6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING A VARIANCE. (NO. 959) .-~ WHEREAS, the Oity Planning Commission of the Oity of Ana- heim did receive a petition from the property owner ~ of certain real property situated in the City of Anaheim, Oounty of Orange, State of California, described as follows: Beginning at a point on the North line of Section 13, Township 4 South, Range 11 West, S.B.B. & M., said point of beginning being North 89041 '15" East 332.08 feet from the Northwest corner of said Section 13; thence South 0010'25" East 1339.14 feet to a point in the South line of the North half of the Northwest quarter of said Section 13, said point being North 89037'30" East 332.16 feet from the intersection of said South line with the West line of said Section 13; thence North 89037'30" East along said South 1 ine, 173.08 feet to a point; thence North 0010'1511 West, parallel to the West line of said Section 13, 1338.95 feet to a point in the North line of said Section 13; thence South 89041'15" West 173.16 feet to the point of beginning. (Said property is located at 2956 West Lincoln Avenue, Anaheim.) AND WHEREAS, the City Planning Commission did hold a pub- lic hearing at the City Hall in the Oity of Anaheim upon said peti- tion on l4av t) 1958 , notices of which said public hearings were luly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investiga- tion and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 249 ,recommending to the City Coun- cil of the City of Anaheim that Variance No. 919 be granted upon the conditions stated in said resolution; an WHEREAS, the City Council does find that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or claes of use in the same vicinity and zone. _. 2. That such a variance is necessary for the pre- servation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not ad- versely affect the comprehensive general zoning plan. NOW THEREFORE, BE IT RESOLVED by the Oity Council of the City of Anaheim that a conditional zoning variance be. -and the same is hereby granted to KEN G. DOl, 8072 Lincoln Avenue, Anaheim; California, to move a building, which has been used as a real estate office, onto the property hereinabove described, and to use the same for the operation of a real estate office, subject to the following condi Hons: -1- 1. That said building shall be placed 101 feet back from the center line of Lincoln Avenue. ,~, 2. That not more than two signs shall be located on sUbject property, and that the size of these signs shall not exceed 4 ft. by 10 ft. ? ..;. That Variance No. 959 be, and the same is hereby, granted for a period of three (3) years.
