58R-4515 - RESOLUTION NO. 4515 ".,-.., A RESOLUTION OF' 'I'RE CITY COU:NCIL OF THE CITY OF ANAh~IM AUTHORIZING AND APPROVING THE EXECUTION OF AN AGRE~mNT WITH SOUTHERN PACIFIC COMPANY GRANTING TO TEE CITY PERMISSION TO INSTALL A 10-INCH WATER PIPELIN~ BENEATH THE PHOPER'l'Y AND 'fRACKS OF SOU'rHERN PACIFIC COMPANY ON LOS ANGELES STREET AT OR NEAR LEWIS STREET IN THE CITY OF ANAHEIM. WHEREAS, the Southern Pacific Company, a corporation of the State of Delaware, has tendered to the City of Anaheim an indenture granting to the City of Anaheim subject to the terms, covenants and conditions therein contained, the right to construct, reconstruct, maintain and operate a la-inch water pipe line within a 20-inch steel casing, beneath the property and tracks of the Southern Pacific Company at or near West Anaheim Junction, in the County of Orange, State of California, crossing the center line of the Southern Pacific Company's tracks at Engineer Station 1290+10, in the location shown in red on the print of the Southern facific Company's Los Angeles Division Drawing A-4988, Sheet No.1, dated Jan. 28, 1958, attached to and made a part or the indenture above mentioned; said pipe line to be construct- ed and maintained in accordance with the specifications in- dicated on the print or DrawinG C. S. 1741 of the Southern Paciric Company; AND ~iEREAS, said grantor has tendered to the City of Anaheim the indenture above mentioned to be executed by said Southern Pacific Company and the City or Anaheim, which inden- ture the City Council finds would be for the benefit and best interest of the City of Anaheim and should be approved. NOW, THEREFORE, BE L' HESOLVED by the City Counci 1 of the City of Anaheim that the indenture tendered to the City of Anaheim by the Southern Pacific Company, a corporation of the State of Delaware, granting to the City, but subject to the terms, covenants and conditions therein contained, the right to con- struct, reconstruct, maintain and operate a lO-inch water pipe enclosed within a 20-inch steel casing, beneath the tracks and property of Southern Pacific Company, in the County of Orange, State of California, crossing the center line of Southern Pacific Company's track at l!;ngineer Station 1290+10, as hereinabove more particularly described, be, and the same is, hereby approved and accepted; and BE 1'1' F'UR'rEEH RESOLVED that the 11ayor and the Ci ty Clerk be, and they are, hereby authorized to execute said indenture for and on behalr of the City of Anaheim; and ,....... ~ BE I'1' PUR'rHEH RESOLVED that the City Auditor of the City of Anaheim be, and he is, hereby authorized to pay to the Southern Pacific Company the sum of Twenty-five Dollars ($25.00). -1- ,""".- -. ~ THE c"OREGOING R.c.SOLUTION is approved and signed by me this 13th day of May, 1958. ~ V /'/ .----- HAOR~~ ~ A'rllIESI~(I : ~&O~tiAI1EIM STATE OF' CALIfi'OmHA COUNTl 01<' ORMGE CITY OH' ANAHEIM ) } ss. } I, DENE M.
