58R-4859 -- - R!SOLUTION NO. 4859 A RESOLUTION OP' THE CITY COUNCIL OP' THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANG! OF ZON! IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANG! OF ZONE. WHEREAS, th.City Planning Commission of the City of Ana- hela has heretofore duly passed and adopted a re.olution declaring it. intention to change the boundaries of the zone or zones herein~ after mentioned and delcribed and did fix a time and place for the holding ot a public hearing thereon in the manner and al pre.cribed In Article IX, Chapter 2 of the Anaheim MUnicipal Code, and did duly hold and conduct such public hearing to consider said proposed change of zone or zones, and did receive evidence and report. from person. interested therein; and WHEREAS, within a period of forty (40) days tollowing the final hearing thereon, the Planning Commission did duly announce by tor..l resolution it. findings of facts and declare its opinions and re..ons for recommending an amendment to said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed chang.. in the boundaries ot the zone hereinatter mentioned and described, and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the 11th day of November , 19 58 , as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article IX, Chapt.r 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public h.ar- ing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and report., and did thereupon con- lider the recommendations of the City Planning Comml.llon, and WHEREAS, the City Council does find and determine that the property and ar.a proposed to be changed trom the zone In which It 1. now tltuat.d to a different zone, .. hereinafter let forth, il more lultable for the zone or zone. to which it il propoled to change .aid property and area and that the inclusion ot said property and area in such n.w zone or zon8S will increase the value of said property and are. and will not depreciate the value. or property in adjoining zoneSe NOW, THEREFORE, BE IT RESOLVED by the Ctty Councilor the City of Anaheim that all or the property and area 11tulted In the City or Anaheim, County or Orange, State of Callrornla, delcrlbed al rollo.l, to wit: -- The East 200 feet of the South 4 acres of the East 10 acres of the South 20 acres of the Southeast quarter of the Northeast quarter of Section 18, Township 4 South, Range 10 West, S.B.B. & M., EXCEPTING THEREFROM the South 190 feet. That the building to be erected on subject property be con- structed essentially in accordance with the plans submitted to the City Council and on file with the City of Anaheim. 2. That the owner of subject property deed to the City of Anaheim a strip of land 60 feet in width from the center line of the street, along Brookhurst Street, on the west side, for street widening purposes; and a strip of land 40 feet in width from the center line of the street, on the north side of Orange Avenue, commencing at a point 180 feet west of the center line of Brookhurst Street and extending westerly a distance of 20 feet. 3. That all engineering requirements of the City of Anaheim, along Brookhurst Street and Orange Avenue, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities or other lDartinent work be complied with as required by the City Engineer, - in accordance with plans and specifications on file in the office of said City Engineer. 4. That the owner of subject property place of record standard City of Anaheim C-3 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the C-3 uses of sub- ject property to a wheel alignment and brake adjustment shop or to any C-l uses. 5. That the above conditions shall be complied with within a period of 90 days from date hereof. 6. That final inspection of the building to be erected on subject property shall not be made until all improvements or engineer- ing requirements have been complied with.
