58R-4779 -- RESOLUTION NO. 4779 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING A VARIANCE (NO. 1026). ~. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from the prop- erty owners and/or a~ent of certain real prop- erty situated in the City 0 Anaheim, County of Orange, State of California, described as follows: Lots 1 to 44. both inclusive, of Tract No. 23l7, in the City of Anaheim, County ~f Orange, State of California, as shown on a map thereof recorded in Book 104, Pages 12 and 13. Miscellaneous Maps, Records of Orange County, California. AND WHEREAS, the City Planning Commission did hold a pub- lic h~aring at the City Hall in the City of Anaheim upon said peti- tion on S~ptp.~hp.~ 8, 195A . notices of which said public hearing were du y given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investiga- tion and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 4~ . recommending to the City Coun- cil of the City of Anaheim that Variance No. l026 be granted upon the conditions stated in said resolution; and WHEREAS, the City Council does find that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the pre- servation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. ,,-... 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not ad- versely affect the comprehensive general zoning plan. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted to DON COLEMAN, 1545 Katel1a Avenue, Anaheim, California, permitting Single-family residences, with a minimum livable floor space area of l,225 square feet, on the property hereinabove described, upon condition that light shake roofs be -1- -- applied on the buildings on Lot No. l; Lots Nos. 8 to l7, both inclusive; Lots Nos. 30 and 3l; and Lots Nos. 38 to 44, both inclusive. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners or their heirs, successors or assigns, to comply with the Anahei~unicipal Code and regulations and the conditions herein.
