RES0LUTlON NO. 4735 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING A SEALED PROPOSAL AND AWARDING A CONTRACT TO THE M:)ST RESPONSIJaLE LOW BIDDER FOR THE FURNISHING OF LICUlD CHLORINE TO THE ORANGE COUNTY JOINT OUTFALL SEWER. WHEREAS, the City Council of the City of Anaheim, as contracting agent for the Orange County Joint Outfall Sewer, did cause to be published in a newspaper of general circulation, printed, published and circulated in the City of Anaheim, to wit: the Anaheim Gazette, on the 14th and 21st days of August, 1958, a notice inviting sealed proposals for the furnishing to the Orange County Joint Outfall Sewer of the following approxi- mate quantities of liquid chlorine: An estimated quantity of 200,000 to 300,000 pounds of liquid chlorine of commercial quality, supplied in containers of 2,000-pound capacity, net weight. Shipment of full cylinders and return of empty cylinders to be prepaid by bidder to any location requested by the buyer. A list of these locations and past usage of chlorine is available at the office of the Orange County Joint Outfall Sewer, 719 s. Loara Street, Anaheim, or the office of the City Clerk in the City Hall, Anaheim, California. AND WHEREAS, said notice did prOVide that all bidders were requested to visit all of the sites to be supplied and to arrange for inspection of bidder's facilities by buyer; and WHEREAS, said notice did further provide that the contract to be awarded shall be for a period of one (I) year from date of contract, and all deliveries of chlorine shall be in accordance with specifications therefor on file in the office of the City Clerk of the City of Anaheim and the office of the Orange County Joint Outfall Sewer at 719 S. Loara Street, Anaheim, California; and ,...-.,. WHEREAS, such notice inviting sealed proposals for said liquid chlorine did provide that said sealed proposals would be received by the City of Anaheim, as contracting agent for the Orange County Joint Outfall Sewer, at the office of the City Clerk of said City up to the hour of 2:00 o'clock P.M. on August 28, 1958, and would be opened on said date at the hour of 2:00 o'clock P.M., in public, in the City Council Chambers in the City Hall, in the City of Anaheim, State of California, by the City Clerk and the City Engineer, for the furnishing to said Orange County Joint Outfall Sewer of said liquid chlorine; and WHEREAS, the City Clerk of the City of Anaheim did receive the following sealed proposals prior to 2:00 o'clock P.M. on the 28th day of August, 1958, in response to the notice afore- said inviting sealed proposals, to wit: -1- ,~ - .-.. Cylinders loaned free for 90 days; $1.00 per day demurrage will be charged after the free use period. -2- - - -....-...- AND WHEREAS, the City Engineer did thereupon examine and tabulate said sealed proposals and did report to the City Council the result of his examination and tabulation; and WHEREAS, the City Council finds that the sealed pro- posal submitted by TOPS CHEMICAL COMPANY, 1727 Buena Vista, Duarte, California, is the most responsible proposal submitted for the furnishing of liquid chlorine as specified in the notice inviting sealed proposals, and in accordance with the specifications therefor on file in the office of the City Clerk of the City of Anaheim and the office of the Orange County Joint Outfall Sewer, and that said proposal of TOPS CHEMICAL COMPANY should be accepted and the contract awarded to said company for furnishing said liquid chlorine. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, as contracting agent for the Orange County Joint Outfall Sewer, that said proposal submitted by TOPS CHEMICAL COMPANY, 1727 Buena Vista, Duarte, Cal ifornia, for the furnishing of liquid chlorine as specified in the notice inviting sealed proposals and in accordance with the specifications therefor on file in the office of the City Clerk of the City of Anaheim and the office of the Orange County Joint Outfall Sewer, Anaheim, California, be, and the same is hereby accepted, and that a contract for the furnishing of said liquid chlorine be, and the same is hereby awarded to said TOPS CHEMICAL COMPANY; and BE IT FURTHER RESOLVED that the award of said contract to said TOPS CHEMICAL COMPANY is declared to be for approximate quantities as set forth in the notice inviting sealed proposals; and BE IT FURTHER RESOLVED that the successful bidder be, and it is hereb~ required to execute a contract in the required form satisfactory to the City of Anaheim, and upon the terms and conditions specified in the notice inviting sealed proposals and the proposal submitted by it, and in accordance with the speci- fications for liquid chlorine on file in the office of the City Clerk of the City of Anaheim and the office of the Orange County Joint Outfall Sewer, Anaheim, California; and BE IT FURTHER RESOLVED that said bid be, and the same is hereby, accepted for delivery of said liquid chlorine at the times and locations as specified by the Manager of the Orange Ceunty Joint Outfall Sewer; and BE IT FURTHER RESOLVED that the successful bidder be, and it is hereby, required to furnish, within ten days after the award of the contract, a surety bond payable to the City of Anaheim, and subject to the approval of the City Council, in an amount not less than fifty (50) per cent of the aggregate amount of said contract, which bond shall be conditioned upon the faithful performance of said contract; and - BE IT FURTHER RESOLVED that the Mayor and the City Clerk of the City of Anaheim be, and they are hereby, authorized and directed to execute for and on behalf of the City of Anaheim, as purchasing agent for the Orange County Joint Outfall Sewer, with TOPS CHEMICAL COMPANY, a written contract for the furnishing of said liquid chlorine in accordance with the speCifications therefor, the notice inviting sealed proposals, the terms of this resolution, and the contract approved by the City Attorney of the City of Anaheim; and -3- - .- BE IT FURTHER RESOLVED that the term of said contract shall be for a period of one year from date of award thereof.
