A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM GRANTING VARIANCE NO. 998.
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from the
owner of certain real property situated in the City of Anaheim,
County of Orange, State of California, described as follows:
The South 60 feet of the North 180 feet of the
West half of the Southwest quarter of the South-
east quarter of the Southwest quarter of Section
2, Township 4 South, Range 10 West, in the
Rancho San Juan Cajon de Santa Ana, in the City
of Anaheim, County of Orange, State of California,
as said section is shown on a map recorded in Book
51, Page 10 of Miscellaneous Maps in the Office
of the County Recorder of said County.
(Said property is located at 1039 Liberty Lane,
Anaheim, California.)
AND WHEREAS, the City Planning Commission did hold
a public hearing at the City Hall in the City of Anaheim
upon said petition on July 7, 1958, notices of which said
public hearing were duly given as required by law and the
provisions of Section 9200.17 of the Anaheim Municipal Code;
and
WHEREAS, said Commission, after due inspection, in-
vestigation and studies made by itself and in its behalf, and
after due consideration of all evidence and reports offered
at said hearing, did adopt its Resolution No. 10--Series
1958-59 recownending to the City Council of the City of
Anaheim that Variance No. 998 be denied; and
WHEREAS, the City Council does find that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the
property involved or to the intended use of
the property that do not apply generally to
the property or class of use in the same
vicinity and zone.

2. That such a variance is necessary for the
preservation and enjoyment of a substantial
property right possessed by other property
in the same vicinity and zone and denied to
the property in question.
3. That the granting of such variance will not be
materially detrimental to the public welfare nor
injurious to the property or improvements in
such vicinity and zone in which the property is
located.
4. That the granting of such variance will not ad-
versely affect the comprehensive general zoning
plan.

NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that a conditional zoning variance be,
and the same is hereby granted to DAVID S. HARNEY, 1039
Liberty Lane, Anaheim, California, to split the the property
hereinabove described into two lots, one fronting on Liberty
Lane and one fronting on Rosemont Street, subject to the fol-
lowing conditions:
1. That the owner of subject property pay to the
City of Anaheim the sum of $327.00 for sewer
and water connections.
2. That too owner of subject property deed to the
City of Anaheim a strip of land 32 feet in
width, from the center line of the street,
along Liberty Lane for street widening pur-
poses.
3.
That all engineering requirements of the City
of Anaheim, such as curbs and gutters, side-
walks, street grading and paving, drainage
facilities or other pertinent work, be complied
with as required by the City Engineer.
4.
That the owner of subject property pay to the
City of Anaheim the sum of $25.00 per lot f~
the acquisition of park and recreation sites.
5.
That a Record of Survey be filed in the Office
of the County Recorder of Orange County,
California.
6.
That the lot fronting on Rosemont Street be
ninety (90) feet in depth.
The City Council hereby reserves the right .to re-
voke such variance permit for good cause or failure ~f said
owner, his heirs, successors or assigns, to comply wi th t he
Anaheim Municipal Code and regulations and the conditions
herein. Said variance is granted for the term prescribed by
the Anaheim Municipal Code unless otherwise specified herein.
THE FOREGOING RESOLUTION is approved and signed by
me this 26th day of August, 1958.
