RESOLUTION NO. 4710
A RESOLUTION OF THE CITY CClIllCIL OF THE CITY
OF AJWfEIM DEIIYIIfG VARlAlfCE RO. 1007..

WHEREASJ the City Planning Co..ission of the City of
Anaheim did receive a petition for &oninl variance from the
owner, Vainer Realty Company, of certain real property situated
in the City of AnaaeiaJ County of Orange, State of California,
descri.ed a. follows:
That portion of the NWt of the sWl of Section 12, Township
4So.thJ Range 10 Vest. in the Ran~ho San Juan Cajon de
Santa AnaJ County of Orange, State of California as said
section ia shown on a map filed in Book 51, Page 10 of
Miscellaneou. MapsJ in the office of the county recorder
of said countYJ described as follows:
~_~9i.ning at the intersection of the Vest line of said
KWt with the center line of Anaheim-Olive Road as descriaed
in deed recorded in Book 275, Page 85 of Deeds, records of
said county; thence South 0-11'45" Vest, along the Vest
line of said NVl, aaid West line also being the center line
ef Placentia Avenue, 272.50 feet; thence South 89-48'15"
East 150.00 feet to the True Point of Beginning; thence_
Sout. 8~-48'15. East 102.50; thence North 0-11'45" East
parallel with said center line of Placentia Avenue; 223.74
feet, more or less, to the point in the center line of
Anaheim-Olive Road; thence North 78-52'26" West, along said
center line of Anaheim-Olive Road 5~.66 feet, more or less
to a point distant thereon South 78 52'26" East 202.50 feet
from the intersection of the Vest line oLsaid wi; thence
South 0-24'1~" East 134.85 feet; thence parallel with said
center line of Anaheim-Olive Road North 78-52'26" West to
a point in a line parallel with the said center line of
Placentia Avenue and passing through the True Point of
iegianing; thence along said parallel line, South 0-11'4.5"
Vest to the True ~int of Begianing.
AND WHEREAS, the City Planning Commission did hold a
~blic hearing at the City Hall in the City of Anaheim on
July 21, 1958, notices of which said public hearimg were duly
given as reqaired by law and the prOVisions of Section 9200.17 of
the Anaheim Manicipal Code; and
WHEREASJ said City Planning CommissionJ after due in-
spection, investigation and studies made by itself and in its
aehalf, and after d.. consideration of all evidence and reports
offered at said hearingJ did adopt aesolution No. 23, Series
1958-59, recommending that Variance No. 1007 be granted subject
to the condition therein set forth; and
WHEREAS, thereafter, within twemty (20) days from the
date of the adoption of said resolutionJ the City Council did
electJ upon its $WR motionJ to review the action taken ~y the
City Planniag CommiSSion in granting said variance and did set
a public hearing thereon to be held on the 19th day of ~gust,
1958, at 1:00 o'clock P.M. in the City Hall in the City of
Anaheim, and notice of such public hearing was duly given as
required by law and the prOVisions of Section 9200.17 of the
Anaheim Manicipal Code; and

WHEREAS, the City Council Qoes fina that:
1. There is no substantial property right possessed
by other property in the saae vicinity ana zone
and denied the subject preperty.
2. It appears that the .ubJect property can be ade-
quately developed and used under the present zone.
NOlr/J THEREFORE, IE IT RESOLVED by the Ci ty CouRcil of
the City of Anaheim that the action of the City Planning Commission
granting Variance No. 1007 requesting permission to operate a
restaurant and bar, on the property hereinabove de.cribed, be and
the same i8 hereby disapproved, and that Variance No. 1007 be, and
the same is hereby denied.
THE FOREGOING RESOUITION is approved and signed by me
this 19th day of Aagust, 1958.
