58R-4696 - RESOLUTION NO. 4696 "~- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANA- HEIM ACCEPTING A SEALED PROPOSAL AND AWARDING A CON- TRACT TO THE LOWEST RESPONSIBLE BIDDER FOR THE FURNISHING OF ALL PLANT, LABOR, SERVICES, MATERIALS AND EQUIPMENT AND ALL UTILITIES AND TRANSPORTATION, INCLUDING POWER, FUEL AND WATER, AND PERFORMING ALL WORK NECESSARY TO CONSTRUCT AND COMPLETE THE FOLLOW- ING PUBLIC IMPROVEMENT: THE ORANGE AVENUE SEWF.R IMPROVEMENT. WHEREAS, the City Council of the City or Anaheim did cause to be published in a newspaper or general circulation, printed, published and circulated in the City or Anaheim, to wit: The Anaheim Bulletin, on the a notice invit ng . All plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete, in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the office of the City Clerk or City Engineer of the City of Anaheim, the following public improvement, to wit: The Orange Avenue Sewer Improvement, consisting of the con- struction of a V.C.P. sewer lateral in Orange Avenue, from Magnolia Avenue to 1505 feet west of Magnolia Avenue, including trenching, back-fill, manhole con- struction and appurtenant work, as indicated on the plans, Job No. 1115, in accordance with the design, plana, proriles and specifications of said public improvement on rile in the orrice or the City Clerk or the City of Anaheim; and WHEREAS, eaid notice inviting sealed proposals for said public improvement did provide that sealed proposals would be received by the City of Anaheim at the orfice of the City Clerk of the City of Anaheim up to the hour of 2:00 o'clock P.M. on the 7th day of Att~st . 19~, for the rurnishing of all plant, labor, services, materials, and equipment, all utilities and transportation, including power, ruel and water, and perrorming all work necessary to construct and complete in a good and workmanlike manner, the public improvement hereinabove more particularly mentioned and described, and which notice did state and declare that pursuant to the provisions or Section 1770 of the Labor Code, the City Councilor the City or Anaheim had ascertained the prevailing rate or wages in the locality in which this type of labor is to be performed for each crart or type or workman or mechanic needed to execute the contract and did set rorth the prevailing hourly wage scale so ascertained; and -- WHEREAS, the City Clerk of the City of Anaheim did rollowing sealed proposals prior to 2: 00 0' clock P.M. on day of Au~ust , 19~, in response to the notice inviting sea ed proposals, to wit: receive the the 7th aroresaid -1- - ,- !!!'!! WeS~l~ter Avenue, Gar!en Grave, Califn~nia is t e owest responsib e proposal submitted for the furnishing or all plant, labor, services, materials and equipment, all utilities and transportation, including power>> ruel and water and perrorming all work necessary to construct and complete in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings there- ror on rile in the office or the City Clerk or the City of Anaheim, the public improvement hereinabove mentioned and described, together with the appurtenances thereto>> and as specified in the notice inviting sealed proposalsp and that said proposal or said above named bidder should be accepted and a contract awarded to said bidder in accordance therewith, and WHEREAS, the City Council rinds that the above mentioned sealed proposal is the lowest responsible proposal received and that the per- son, rirm or corporation submitting said proposal is a responsible person, rirm or corporation and that the proposal submitted is the best suited and ritted for the public improvement to be constructed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City or Anaheim, that the sealed proposal submitted by PLUMBING CONTRACTORS,INC., SANIT~Y DIVISION, 11662 E. Westminster Ave., Garden Grov~, California, rOr t e furnishing of all plant, labor, services, materia s and equip- ment, all utilities and transportation, including power, ruel and water, and performing all work necessary to construct and complete, in a good and workmanlike manner~ in strict accordance with the specirications, plans and drawings thereror on file in the of rice of the City Clerk of the City or Anaheim and the notice inviting sealed proposals, the pub- lic .works and improvement hereinabove more particularly mentioned and described, together with the appurtenances thereto, he, and the same is hereby, accepted~ and that a contract ror the construction and com- pletion or said publiC improvement be, and the same is hereby, awarded to the said above named biddero - AND BE IT FURTHER RESOLVED that the successful bidder or bidders upon each contract awarded as hereinabove set rorth, shall be, and they are hereby required to execute a contract in the required rorm with the City or Anaheim upon the terms and conditions speciried in the notice inviting sealed proposals and the proposal submitted by said success- ful bidder or bidders and in accordance with the plans and specirica- tions ror said public improvement hereinabove described, and in accord- -2- C_ ance with the terms, conditions and provisions of this resolution, and that said successful bidder or bidders to whom each contract is awarded shall be required to furnish a surety bond in an amount equal ~ to one hundred per cent (100%) or the contract price ror all labor, materials and equipment to be rurnished and performed, as set rorth in the sealed proposal submitted by said bidder ror the construction of said public improvement, together with the appurtenances thereto or such portion thereor as is covered by said contract, as security ror the raithful perrormance of said contract and a separate surety bond in an amount equal to one hundred per cent (lOO%) or the con- struction cost or said public improvement covered by said contract, as security ror the payment of all persons performing labor and rur- nishing material for said projecto AND BE IT FURTHER RESOLVED that said successrul bidder or bidders be, and they are hereby required to rurnish to the City of Anaheim in companies satisractory to the City of Anaheim, public lia- bility, property damage, compensation, and other insurance in the amounts and ror the purposes as set forth and specified in the notice inviting sealed proposals, and subject to the approval or the City Attorney as to form and sufriciency. AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk of the City or Anaheim be, andCthey are hereby, authorized and directed to make, execute and enter into, for and on behalr or the City or Anaheim, a written contract with said successrul bidder or bidders for the furnishing of all plant, labor, materials, and equip- ment and perrorming all work, as hereinabove more particularly des- cribed, ror the construction, installation and completion of said public improvement hereinabove described upon the terms and conditions as specified in the notice inviting sealed proposals, the detailed design, plans, profiles, drawings and general specirications and de- tailed specifications and drawingsg and all addenda thereto, and all modirications incorporated therein prior to the date or the opening or bids, on rile in the office or the City Clerk of the City or Ana- heim and in strict accordance with the terms, conditions and provisions or this resolution, and in accordance with all of the contract docu- ments herein speciried.
