RESOLUTION NO. 67R- 36
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE EXECUTION OF AN
AGREEMENT WITH ORANGE COUNTY WATER DISTRICT
WITH REFERENCE TO IMPROVEMENT OF LA PALMA
AVENUE AND DEDICATION OF AN EASEMENT FOR PIPE-
LINE PURPOSES.
WHEREAS, Orange County Water District and the City
of Anaheim have heretofore entered into an escrow with First
American Title Insurance & Trust Company wherein Orange County
Water District is exchanging certain real property in the City
of Anaheim for certain real property in the City of Anaheim
owned by the City; and
WHEREAS, one of the conditions set forth in said
escrow provides that the parties will execute an agreement
wherein said Water District will agree to pay for a portion of
the improvements of La Palma Avenue, and the City will agree
to convey a pipeline easement to said Water District, which
condition is a portion of the consideration for said exchange.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that an agreement be made and entered into
between the City of Anaheim and Orange County Water District
providing as follows:
1. At such time as the City constructs La Palma
Avenue along the northerly boundary of said
Water District's property adjacent to the
properties being exchanged in said escrow above-
mentioned, said Water District shall pay to the
City a sum equal to the cost of 18 feet of pave-
ment plus curbs and gutters not to exceed 2-1/2
feet in width along the full length of the
northerly boundary of said Water District
property. Said payment shall be made by said
Water District at such time as said construction
is completed and the City has furnished said
Water District with a statement of the cost of
construction of said 18 feet of pavement plus
curbs and gutters not to exceed 2-1/2 feet in
width.
2. At such time as said Water District is ready to
construct a pipeline connecting its facilities
located southerly of La Palma and easterly of
Jefferson Street in the City of Anaheim to the
Metropolitan Water District feeder line, the City
shall convey and grant an easement to said Water
District over and across the property located
easterly of Jefferson Street and westerly of the
property conveyed by the City to said Water Dis-
trict in the aforesaid escrow for pipeline
purposes. Said conveyance shall be made without
further consideration by way of payment of money
or otherwise.

3. Said agreement shall be delivered into the above-
mentioned escrow and shall become effective and be
delivered to the respective parties only upon the
close of said escrow.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby, authorized to execute such agreement
for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me this 17th day of January, 1967.
