57R-4097 - --._-~ RESOLUTION NO. 4097 Copies to: P~rsoDnel A RESOLUTION OF THE CITY COUNCIL OF THE cfWoll OF ANAHEIM ADOPTING A POLICY AND RULES AND REGULATIONS RELATING TO SICK LEAVE OF CITY EMPLOYEES AND REPEALING RESOLUTION NUMBER 182.9. WHEREAS, the City Council of the City of Anaheim determines that it is necessary to adopt new rules and regulations relating to sick leave of City employees; and WHEREAS, the City Council finds that it would be for the best interest and welfare of the City of Anaheim and the City employees thereof to adopt a definite policy and rules and regulations relating to sick leave granted or to he granted to City employees of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a policy of granting sick leave be and the .&me is hereby adopted and that the granting of such sick leave shall be governed and determined by the following rules and regulations and such others as nay from time to time be adopted by the City Council: 1. Sick leave with pay shall accrue at the rate of one working day for each full calendar month of the employee's service, and any such leave accrued but unused in any year shall be accumulative for succeeding yea. up to a ma.ximum of one hundred eighty (180) working days. Employees who are granted a leave of absence with pay for any purpose shall continue to accrue sick leave at the regularly prescribed rate during such absence. 2. An employee eligible for sick leave with pay shall be granted such leave for the following reasons: (a) personal illness or physical incapacity resulting from causes beyond the employee's control; (b) enforced quarantine of the employee in accordance with community health regulations; or (c) the death of a member of the employee's immediate family. An employee on sick leave shall inform his immediate superior of the fact and the reason therefor as soon as possible, and failure to do so within a reasonable time may be cause for denial of sick leave with pay for the period of absence. 3. An employee receiving sick leave with pay who simultaneously receives compensation under workman1s compensation laws shall receive, for the period of aick leave to which hi ili entitled, only that portion of his regular salary which will, together with said compenSation, equal his regular salary. ,-..-- 4. Officers and employees who are in the service of the City at the time this rule takes effect shall be entitled to an - accumulation of unused sick leave credits at the rate of one day for each calendar month of prior service, said unused credits not to exceed a total accumulation of thirty days. ."-- 5. Sick leave with pay in excess of three conaecutive working days for reasons of personal illness or physical incapacity shall be granted only after presentation of a written state- ment by a reputable physician certifying that the employee's condition prevented him from performing the duties of his position. The Personnel Director, may in his discretion require that said examination be performed by a physician who has not attended the employee for at least five (5) years prior. Appropriate forms for such a statement will be furnished by the Personnel Director.
