57R-4096 >- - r-- RESOLUTION NO. 4096 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE EXECUTION AND DELIVERY OF A GRANT DEED TO DONALD R. BATES. Copy forwarded Auditor WHEREAS, the City of Anaheim is the owner of the following described real property, to wit: The Easterly 50 feet of the Westerly 300 feet of the Southerly 346 feet of that parcel of land located in the City of Anaheim, County of Orange, State of California, and being a portion of the sEt of Section 3, Township 4 South, Range 10 West, S.B.B.& M., described as follows: Beginning at the Northeast corner of the Schaffer Oswald Subdivision as shown on a map thereof in Book 7, Page 41 of Miscellaneous Maps of Orange County, California; thence Westerly along the North line of said subdivision 785.10 feet to its intersection with the East line of North Olive Street, 40 feet wide; thence Northerly along said East line of North Olive Street 667.15 feet to the South line of the land conveyed to Cal-Juices, Inc. by Deed recorded January 26, 1938 and filed in Book 922, page 262 of Official Records of said Orange County; thence East along said South line 742.05 feet more or less to the West line of the right of way of the main line of the Los Angeles and Salt Lake Railroad Company (now known as the Atchison, Topeka and Santa Fe Railroad) in said Section 3; thence Southerly 251.91 feet along said right of way line which forms a curve, concave Easterly with a radius of 5764.65 feet to its intersection with the East line of the wi of the SEt of said Section 3; thence Southerly along said East line 419.10 feet to the point of beginning. AND WHEREAS, on June 12, 1956, by Resolution No. 3318, the City Council did find and determine that said property was not needed for immediate public use, nor municipal purposes and, there- fore, that it would be for the benefit and best interest of the City of Anaheim that it accept the offer of one Donald R. Bates, granting to him in conjunction with the sale of another and different parcel of property more particularly described in said Resolution as Parcel No.1, a one-year option to purchase said above described property for the sum of $5,160.00; and .- WHEREAS, on June 13, 1956, the City of Anaheim did execute and deliVer to said Donald R. Bates a one-year option to purchase said above described property for the sum of $5,160.00 upon and sub- ject to certain conditions and terms set forth therein; and WHEREAS, within said one-year period of time, said Donald R. Bates did exercise said option pursuant to the terms and condi- tions thereof by depositing in escrow with the Bank of America, N.T.& S.A., Fullerton, California, Branch, the sum of $5,160.00. NOW, THEREFORE, BE IT RESOLVED by the City COUIlciLo.t:the City of Anaheim that the Mayor and the City Clerk be, and they are hereby, authorized to execute a good and sufficient deed conveying to said Donald R. Bates the hereinafter described real property, -1- -" ~ and to deliver said deed into escrow at the Bank of America, N.T.& S.A., Fullerton, California, Branch, to be delivered to said Donald R. Bates upon completion of said escrow and the payment of the full purchase price as herein provided.
