57R-4093 - .-- RESOLUTION NO. 4093 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF M1AHEIM DENYING VARIM1CES NOS. 803 TO 807, BOTH INCLUSIVE. WHEREAS, the City Planning Commission of the City of Anaheim did receive petitions from the Lessee of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: Variance No. 803 - The South side of Ball Road between West Street and the Santa Ana Freeway; Variance No. 804 - The Northeast corner of Ball Road and Harbor Boulevard-- between Harbor Boulevard and South Palm Street; Variance No. 805 - The Southeast corner of Vermont Avenue and the Santa Ana Freeway; Variance No. 806 - The South side of Vermont Avenue just East of Citron Street; Variance No. 807 - Near the Northwest corner of Palm Street and Hampshire AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petitions on August 5, 1957, notices of which said public hearing were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and \IHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. J3--Series 1957-58, recom- mending to the City Council of the City of Anaheim that Variances Nos. 803 to 807, both inclusive, be granted upon the conditions therein set forth; and VlHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in granting said variances and did set a public hearing thereon to be held on the 10th day of September, 1957, at 7:00 olclock P.M. in the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and r- WHEREAS, at the time and place fixed for said pUblic hearing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did there- upon consider the recommendations of the City Planning Commission; and -1- - WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find that: ,- 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zone. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting Variances Nos. 803 to 807, both inclusive, requesting permission to erect temporary directional signs advertising apart- ment rentals on the properties hereinabove described, be and the same is hereby disapproved, and that Variances Nos. 803 to 807, both inclusive, be, and the same are hereby, denied.
