57R-4065 ,.-, -- .~ RESOLUTION NO. 406S A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE M~ENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed amd adopted a resolution reoommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a public hearing thereon in the manner and as prescribed in Arti~le IX, Chapter 2 of the Anaheim Municipal COde, and after having duly held and conducted such pUblic hearing to consider said proposed change of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days follow- ing the hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for reoommending a denial of said proposed ohange in the boundaries of the zone or zones hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the 27th day of August, 1957, as the time and the Council Chamber in the City Hall of the City of Anaheim as the plaoe for a public hearing upon said proposed change of zone or zones, and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did thereupon consider the reco~~endations of the City Plan~ing Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, is more suitable for the zone or zones as hereinafter set forth and that the in- clusion of said property and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of property in adjoining zones. - NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, de- scribed as follows, to wit: Lots 26-46, both inclusive, of Tract No. 2624; and Lots 1-91, both inclusive, of Tract No. 2242 be changed from R-l, SINGLE-FAMILY RESIDENTIAL ZONE, to the fol- lowing zones, upon the conditions hereinafter set forth: -1- ;- rJ&, ,~- :?,.?? .. ,...-.. .-. That Lots 26 to 46, both inclusive, of Tract No. 2624 be changed to R-2, Ti'l'O-FAlvlILY RESIDEN- TIAL ZONE; and .,-.. That Lots 1 to 91, both incl~sive, of Tract No. 2242 be reclassified R.3) MULTIPLE-FAMILY RESIDENTIAL ZONE, subject to the following conditions: 1. That appropriate R-2 and R-3 Deed Re~trictions, approved by the City Attorney, be placed of record covering the re~pective areas; that these restrictions contain the standai-d'archi- tectural contr.o1 provisions, and that the R-3 C-' ",1" - ." J restrictions limit the dwellings erected to not more than four units per lot. 2. 3. That plans, satisfactory to the City Engineer, are to be made providing for the development of the rear of the property owned by Mr. Raymond A. Barnes. BE IT roR~HER- RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Muniaipal Code to accomplish the object herein found and determined to be neoessary and proper.
