I ,'l1l'ing: All plat, labor, services, uterials and eC(Uipllent, and all utilities and tnBspertati_, inclucUag power, fuel aad water, and pert'oraing all _rk necessary to e.su-uct and cOJljplete, in. a 90ed and lIOrm.nJ.ike aanner, in strict accordance with the plans &ad specIfications OIl file in tlile Office of the City Clerk or City Engiaeer of tIB City of AaaheUl, the illprovemeat of the in.tersectien at Harbor Boulevard and 1Ia11 Road, hy tAe coasUuc- tion of a storm drain culvert, curlJ aDd gutter, cross-gutter, paviag with 4-inch p1l1l1t-aix paving, and appurtenant work as indicated on the plans, Job )foe 149, in accordance with the design, plans, profiles and specifications of said public improvement on file in the Office of the City Clerk of the CIty of Anaheim; and WHEREAS, said notice inviting sealed proposals for said public improvement did provide that sealed proposals would be re- ceived by the City Council of the City of Anaheim at the Office of the City Clerk of the City of Anaheim up to the hour of 7:00 o'clock P.M. on the 27tn day of August , 1 95-'L-, for the fur.. nishing of all plant, labor, services, materials and equipment, all ut Ilities and transportation, includ ing power, fuel and water, and performing all work necessary to construct and complete, in a good and ~rkmanlike manner, the public improvement hereinabove more particularly mentioned and described, and which notice did state and declare that pursuant to the provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim had ascertained the prevailing rate of wages in the locality in which this type of labor is to be performed for each craft or type of workman or mechanic c-- needed to execute the contract and did set forth the prevailing hourly wage scale so ascertaIned; and WHEREAS, the City Council of the City of Anaheim did re- ceive the following sealed proposals prior to 7:00 o'clock P.M. on the 27tA day of A..&WIt , 1951-->> in response to the notice aforesaid inviting sealed proposals, to wit: -1- - NAME - UNIT BID PRICE TOTAL PRICE ---. ('..aIT~I, is the lowest responsible proposal submitted for the furnishing of all plant, labor, services. materials and equipment, all utilities and transportation. including power. fuel and water and performing all work necessary to construct and complete in a good and workmanlike man- ner, in strict accordance with the specifications. plans and drawings therefortpn file in the Office of the City Clerk of the City of Ana- heim, the public improvement hereinabove mentioned and described, to- gether with the appurtenances thereto, and as specified in the notice inviting sealed proposals, and that said proposal of said above named bidder should be accepted and a contract awarded to said bidder in accordance tnerewith; and WHEREAS, the City Council finds that the above mentioned sealed proposal is the lowest responsible proposal received and that the person, firm or corporation submitting said proposal is a re- sponsible person, firm or corporation and that the proposal submitted is the best suited and fitted for the public improvement to be con- structedo NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM. that the sealed proposal submitted by all p an , labor, servIces, ma- terials and equipment, all utilitie 'and transportation, including powe~, fuel and water. and performing all work necessary to construct and complete. in a good and workmanlike manner. in strict accordance with the specifications, plans and drawings therefor on file in the office of the City Clerk of the City of Anaheim and the notice invit- ing sealed proposals, the public works and improvement hereinabove more particularly mentioned and described. together wIth the appurte- nances thereto, bep and the same is hereby. accepted, and that a contract for the constr.uction and completion of said public improve- ment be, and the same is hereby, awarded to the said above named bidder. ~~ AND BE IT FURTHER RESOLVED that the successful bidder or bidders upon each contract awarded as hereinabove set forth, shall be and they are hereby required to execute a contract in the required -2- - "- form with the City of Anaheim upon the terms and conditions specified in the not" '~e Inviting sealed p!"oposals and the proposal submitted by said successful bidder or bidders and in accordance with the plans and specifications for said pUblic improvement hereinabove described, and in accordance with the termsp conditions and provisions of this resolution, and that said successful b~dder or bidders to whom each contract is awarded Sht11 be~equired to furnish a surety bond in an amount equal to one hundred per cent (~OO%) of the contract price for all lahorp materials and equipment to he furnished and performed, as set forth in tQe sealedlproposal submJtted by said bidder for the construct~on of sai~ p~blic improvement, tog~therwith the appurte- nances ther~to or such portion thereQf as is covered by said contract, as secur i ty for the fa i thrful perfor,maJJlce of sai d contf'act and a sepa- rate surety bond in an amount equal to one hundred ~er cent (100%) of the construction cost of said public improvement covered by said con- tract, as sec~rity for the payment of all persons performing labor and furnishIng material for said project. AND BE IT FURTHER RESOLVED that said successful bidder or bidders be, and they are hereby required to furnish to the City of Anaheim in companies satisfactory to the City of Anaheim, public liabllity,property dlilmage, compensation, and other insurance in the amount sand f9r the purposes as set forth and specified in the notice inviting sealed proposalsp and subject to the approval of the City Attorney as to form and sufficiency. AND B~~IT FURTHER RESOLVED that,the Mayor and the City Clerk of the City of Anaheim be, and they are hereby, au~horlized and di- rected to make, execute and enter into, for and on behalf of the City of Anaheim, a WTitten contract with said successful bidder or bidders for the furnishing of all plant, labor, materials, and equipment and performing all work, as hereinabove more particularly described, for the construction, installation and completion of said public improve- ment hereinabove described upon the terms and conditions as specified in the notice inviting sealed proposals, the detailed design, plans, profiles, drawings and general specifications and detailed specifica- tions and drawings, and all addenda thereto, and ~ll modifications incorporated therein prior to the date of the operring of bids, on file in the Office of the City Clerk of the City of Anaheim and in strict accordance with the terms, conditions and provisions of this Resolution, and in accordance with all of the contract documents herein specified.
