57R-4025 -- - RESOLUTION NO. 4025 r- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING .AND AUTIIORIZING THE EXECUTION OF A JOINT USE AGREEMENT TO BE MADE AND ENTERED INTO WITH THE PACIFIC TELE- PHONE AND TELEGRAPH COMPANY; AND AUTHOR I ZING PAYMENT TO THE PACIFIC TELEPHONE AND TELE- GRAPH COMPANY OF THE SUM OF $3,452 FOR THE RELOCATION OF CERTAIN TELEPHONE FACILITIES ALONG THE EAST LINE OF HARBOR BOULEVARD. WHEREAS, The Pacific Telephone and Telegraph Com- pany is the owner and in possession of a certain easement descr ibed as: The east 10 feet of the west 40 feet of the south 730 feet of the northeast quarter, and the east 10 feet of the west 40 feet of the north 1320 feet, EXCEPTING the south 340 feet of the north 638 feet of the southeast quarter of Section 22, Township 4 South, Range 10 West, S.B.B. & M. AND WHEREAS, the City of Anaheim has acquired certain lands for highway purposes on Harbor Boulevard; and WHEREAS, the overlapping of said Telephone and Telegraph Company's easement by said highway lands acquired by the City of Anaheim will require that the following de- scribed area within said highway lands shall be subject to the common use of the Pacific Telephone and Telegraph Company and the City of Anaheim: The east 5 feet of the west 50 feet of the south 730 feet of the northeast quarter, and the east 5 feet of the west 50 feet of the north 1320 feet, EXCEPTING the south 340 feet of the north 638 feet of the south- east quarter of Section 22, Township 4 South, Range 10 West, S.B.B. & M. AND WHER.EAS, in the widening of Harbor Boulevard it was necessary for The Pacific Telephone and Telegraph Company to relocate its facilities off of its easement into the common use area above described; and WHEREAS, the cost of such relocation of said fac 11 it ies amounted to $3,1-\.52; and ,.--. WHEREAS, said relocation of facilities was done at the request of the City of Anaheim and the easement of The Pacific Telephone and Telegraph Company was granted and assigned under a Joint Use Agreement to the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the City of Anaheim enter into that certain Joint Use Agreement, dated July 9, 1957, to be made and entered into by and between the City and The Pacific Telephone and Telegraph Company, subject to the terms and conditions therein contained, and that said Joint Use Agree- ment be and the same is hereby approved and accepted. -1- .- - r- BE IT FURTHER RESOLVED that the Mayor and the City Clerk be, and they are hereby, authorized to execute said Joint Use Agreement for and on behalf of the City of Anaheim. AND BE IT FURTHER RESOLVED that the City of Anaheim pay to The Pacific Telephone and Telegraph Company the sum of $3,452 for the relocation of said Telephone and Telegraph Company facilities from an easement owned by said Company to the common area as described in the Joint Use Agreement above mentioned. AND BE IT FURTHER RESOLVED that the City Auditor be and he is hereby authorized and directed to pay to said Pacific Telephone and Telegraph Company said sum of $3,452.
