RESOLUTION NO. 4011

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AIU,HEH1 AUTHORIZING THE PURCHASE
AND ACQUISITION OF CERTAIN REAL PROPERTY
FOR PUBLIC PURPOSES.
WHEREAS, R. M. Thurin, is the owner of the here-
inafter described real property situated in the City of
Anaheim, County of Orange, State of California; and
WHEREAS, said owner has offered to sell said prop-
erty to the City of Anaheim for the sum of $70,000.00 cash,
lawful money of the United states; and
WHEREAS, the City Council does find and determine
that public convenience and necessity require the purchase
and acquisition of said parcel of real property for public
purposes, and thet the price which the owner thereof is
willing to acce~t is reasonable and not out of proportion
to the fair marlcet value of saict property.
NOW, THEREFORE, BE IT :r830LVED by the City Council
of the City of Anaheim that the offer of R. M. Thurin to
sell said property, situated in the City of Anaheim, County
of Orange, state of California, described as follows, to wit:
The South half of the Northeast
quarter of the Southwest quarter
of Section 7, Township 4 South, Range
10 West, S. B. B. & M.
for the sum of $70,000.00 cash, lawful money of the United
States, be, and the same is hereby accepted, subject to the
following terms and conditions:
That subject property shall be conveyed to
the City of Anaheim free and clear of all
encumbrances exceot all taxes for the
fiscal year 195(-58, a lien not yet pay-
able, and covenants, conditions, restric-
tions, reservations, rights, rigbts-of-way
and easements of record.
BE IT FURTHER RESOLVED that the City Administrator
of the City of Anaheim be, and he is hereby, authorized for
and on behalf of the City of A:laheim to sign escrow instruc-
tions for the purchase of said real property and to enter
into an escrow lJi th the miner of seid property at Title
Insurance and Trust Company, Santa Ana, California.

AND BE IT FURTHLR HESOL'.E;D that the City Auditor
be, and he is hereby, authorized to deposit in escrmi at
Title Insurance and Trust Com!)any, Santa Ana, California, the
sum of $70,000.00 cash, la,v-ful money- of the United States,
to be paid to the owner of seid real property when a deed
conveyinQ; sBid propert:'l to the C1 ty of Anaheim free and clear
of all encumbrances, exce9t as hereinabove set forth, can be
recorded r:ncl a policy of title insurance issued by Title

cept as hereinabove specified.
AND BE IT FURTHER I~SOLVED that the seller shall
pay the usual and customary seller's charges for furnishing
a policy of title insurance necessary to show title vested
in the City of Anaheim, as herein provided, and that the
City of Anaheim shall pay the usual buyer's share in the
purchsse of said nronerty.
THE FOREGOING flliSOLUTION is signed and approved by
me this 23rd day of July, 1957.
