57R-3991 ~ .-.-.., _.~ RESOLUT ION NO. 3991 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIU FINDING AND DETERMINING THAT A CHANGE OF ZOOE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF' THE ANAHEIU MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE.. WHEREAS, the City Planning Commission of the City of Ana- heim haa heretofore duly passed and adopted a ~esolution declaring ita Intention to change the boundaries of th~ zone or zones herein- after mentioned and described and did fix a time and place for the holding of a publlc hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public hearing to consider said proposed change of zone or zones, and did receive evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the final hearing thereon, the Planning Commission did duly announce by fo~l resolution its findings of facts and declare its opinions and reasens for recommending an amendment to said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the boundaries of the zone hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the ~day of JUhY , 19 S7 ~ as the time and the Council ~in the City all of the City of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Uunicipal Code; and WHEREAS, at the time and place fixed for said publiC hear- ing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports~ and did thereupon con- sider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proPQsed to be changed from the zone in which it is now tituated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said property and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of property in adjoining zones. NOW, THEREFORE, BE IT RESOLVED by the CIty Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange~ State of California, described as follows, to wit: -"..-... That portion of Lot 7 of Anaheim Ex- tension as per Map of Survey made by William Hamel acknowledged by Alfred Robinson, trustee, recorded in Los Angeles County, California, more particularly described as follows: Beginning at a bolt in the pavement marking the S.E. corner of said Lot 7 and running thence South 74037'30", West 493.55 feet along the South line of said Lot 7 to the true point -1- -", ,- '--,,~ of beginning of the parcel herein described; thence North 120 08' West 24.75 feet to a 4x4 redwood post; thence North 12008' West 466.90 feet to a point 0.27 feet North 74038t30~ Eas~ from a 4x4 redwood post; thence North 740381]0" East 100 feet; thence South 12008' East 491.65 feet more or less to the South line of said Lot 7; thence South 74037'30" West 100 feet more or less to the true point of beginning. be changed from~-A ~;SIPENTIAL-AGRICULTU~ ZOI~. to C-l NEIGHBORHOOD COM}lliRCIAL ZONE, subject to the following conditions: 1. That the owners of subject' property deed to the City at: Anaheim a strip of V:,nd 25.2.5 feet in width along East Center street for street 1ddening purposes. 2. That the owners of subject property place of record standard City of Anaheim C-l Deed Restrictions ap- proved by the City Attorney. J. That a six-foot masonry fence be constructed along the North and West Jroperty lines. 4. That said change of zone shall not become effective unless within 60 days, or such further time as the Council may grant, the restrictions herein required to be impose~ upon the property shall have been executed by the owner of the property, submitted to the City for approval and filed of record, nor un- til deeds for street widening or utility purposes, when required, have been executed and delivered to the City. BE IT FURTHER RESOLVED that the City Attorney be, and 1\. is hereby. authorized and directed to prepare and subm! t to the City Counell an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
