RESOLUTION NO. 3946
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING RESOLUTION NO. 3729, RE-
LATING TO A CHANGE OF ZONE IN CERTAIN AREAS
OF THE CITY, AND RESCINDING RESOLUTION NO. 3868.
WHEREAS, heretorore, to wit, on the 12th day or March,
1957, the City Council did adopt Resolution No. 3729 rinding
and determining that the property described in said resolution
should be changed rrom the classirication or R-A, Residential-
Agricultural Zone, to C-3, Heavy Commercial, and C-l, Neighbor-
hood Commercial Zones, as more particularly set rorth in said
resolution; and
WHEREAS, said resolution did rurther provide, as a con-
dition incident to said reclassirication, that the owners of said
property should deed to the City or Anaheim a strip of land 10
reet in depth along Lincoln Avenue ror street widening purposes;
and
WHEREAS, the City Council does rind upon rurther investi-
gation that the provision requiring the dedication of a strip of
land 10 feet in depth along Lincoln Avenue for street widening
purposes should be eliminated rrom said resolution, and that inas-
much as Lincoln Avenue is a State Highway, arrangements should be
made with the State Highway Department regarding that portion of
the rrontage on Lincoln Avenue required ror street widening pur-
poses; and
WHEREAS, the City Council does rurther rind that Condi-
tion No. 2 or said Resolution No. 3729 erroneously prohibited the
construction or buildings within 100 reet or the wall on the North,
and on the North 300 reet or the West 100 reet; and that said
resolution Should be amended eliminating this provision as to the
area within 100 reet or the wall on the North, and amending it as
to the North 300 reet or the West 100 reet to provide that no
building be constructed in the North 300 reet or the West 100 reet,
unless precise plans ror development are submitted and approved by
the City Council which will provide adequate protection to the
adjacent residents; and
WHEREAS, the City Council does rurther find that as a re-
sult or the objection to said provisions above mentioned in said
Resolution No. 3729, an ordinance has never been adopted directing
said change or zone and completing said proceeding.
NOW, THEREFORE, BE IT RESOLVED by the City Councilor the
City or Anaheim that Resolution No. 3729, heretorore adopted on
March 12, 1957, be and the same is hereby, amended as rollows:
(a) That Condition No.2, reading as follows:
"2. That no buildings be constructed within
100 feet of the wall on the North, and
none on the North 300 feet of the West
100 feet."

less precise plans ror development are

(0) That Condition No.3, reading as follows:
"3. That the owners of subject property deed
to the City of Anaheim a strip of land
10 feet in depth along Lincoln Avenue and
a strip of land 40 feet in depth along
Dale Avenue for street widening purposes."
be changed to read:
"3. That the o,.mers of subject property deed
to the City of Anaheim a strip of land
40 feet in width along Dale Avenue,
measured from the center line thereof,
for street widening purposes, and make
arrangements with the State Highway De-
partment regarding that portion of the
frontage along Lincoln Avenue required for
street widening purposes."
AND BE IT FURTHER RESOLVED that in all other respects
said Resolution No. 3729 be and remain in full force and effect.
BE IT FURTHER RESOLVED that Resolution No. 3868 be, and
the same is hereby rescinded.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby, authorized and directed to prepare and submit to
the City Council an amendment to Article IX, Chapter 2 of the
Anaheim Municipal Code to accomplish the object herein found and
determined to be necessary and proper.
THE FOREGOING RESOLUfION is signed and approved by me
this 18th day of June, 1957.
