57R-3924 .-or,_ '- ,,-.. RESOLUTION NO. 3924 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 742. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition from the property owner of cer- tain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: Parcell: That portion of Section 9, in Town- ship 4 South, Range 10 West, San Bernardino Base and Meridian, in the City of Anaheim, des- cribed as follows: Commencing at a point in the Northerly line of Lot 4, as shown on a Licensed Surveyor's Map, of a portion of said Section 9, made fQr F. W. Fleishchmann and filed in Book 1, Page 56, Re- cord of Surveys, in the office of the 'County Recorder of said Orange County, 289.82 teet Westerly from the center line of West Street as shown on said map; running thence Southerly, parallel with the Easterly line of the West one- half of the Northwest quarter of said Section, 1176.4 feet to the Southerly line of said Lot 4; thence Westerly, along said Southerly line, 794 feet to the true point of beginning of the boundary of the land herein described, said true point of beginning being the Southwest corner of the land described in the deed to John James Schneider and wife, recorded October 18, 1947, in Book 1559, page 225, Official Records, in the office of the County Recorder of said Orange County; thence Northerly along the Westerly line of said land conveyed to Schneider, 426 feet; thence Westerly parallel with the Southerly line of said Lot 4 a distance of 152.25 feet to the Easterly line of Lot 3 of said Fleischmann Sur- vey; thence Southerly along said Easterly line, 426 feet to the Southeast corner of said Lot 3, thence Easterly along the Southerly line of said Lot 4, 152.25 feet to the true point of beginning. EXCEPTING THEREFROM, the Westerly 30 feet thereof. AND WHEREAS, the City Planning Commission did hold a pUblic hearing at the City Hall in the City of Anaheim upon said petition on April 22, 1957, notices of which said public hearing were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 218, recommending to the City Council of the City of Anaheim that Variance No. 742 be granted upon the conditiona stated in said resolution; and .- WHEREAS, the City Council does find that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property -1- - ~..""'" involved or to the intended use or the property that do not apply generally to the property or the class or use in the same vicinity and zone. 2. That such a variance is necessary ror the pre- servation and enjoyment of a substantial pro- perty right possessed by other property in the same vicinity and zone and denied to the pro- perty in question. 3. That the granting or such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting or such variance will not ad- versely arrect the comprehensive general zoning plan . NOW, THEREFORE, BE IT RESOLVED by the City Council of the City or Anaheim that a conditional zoning variance be, and the same is hereby granted to HERBERT E. LAWSON, 1318 Ateca Place, Anaheim, California, to cut off one lot from the above described parcel or property, and establish a 60' x 396' lot on the East side, and a 62.25' x 396' lot on the remainder or said parcel, sub- ject to the rollowing conditions: 1. That all buildings constructed on subject property be erected in accordance with plans presented to the City Planning Commission and on rile with the Ci ty or Anaheim. 2. That all engineering requirements or the City or Anaheim be complied with as required by the City Engineer. The City Council hereby reserves the right to revoke such variance permit ror good cause or railure of said owner, or his heirs, successors or assigns to comply with the Anaheim Muni- cipal Code and regulations and the conditions herein.
