57R-3921 - RESOLUT ION NO. 3921 -....~,~, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Planning CommIssion of the City of Ana- heim has heretofore duly passed and adopted a resolution declaring its intention to change the boundaries of the zone or zones herein- after mentioned and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public hearing to consider said proposed change of zone or zones, and did receive evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the final hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for recommending an amendment to said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the boundaries of the zone hereinafter mentioned and described; and WHEREAS, upon receipt of the ~eport and recommendation of the City Planning Commission, the City Council did thereupon fix the 11th day of June , 19 57 .' as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a publiC hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hear- ing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reportsp and did thereupon con- sider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said property and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of property in adjoining zones. ,- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: PARCEL 1: The West JJO feet Gf -cr.e Northeast quarter of the Northeast quarter of the Southwest qua.rter of Section 27, Township 4 South, Range 10 West, S.B.B.&M., EXCEPTING THEREFROM the West 150 feet of the North 150 feet thereof. -1- ",...... - PARCEL 2: The East 75 feet of the West 150 feet of the North 150 feet of the West 330 feet of the Northeast quarter of the Northeast quarter of the Southwest quarter of Section 27, Township 4 South, Range 10 West, S.B.B.&M. be changed from R-A, RESIDENTIAL-AGRICULTURAL ZONE, to the following zones, upon the conditions hereinafter set forth: That the front or North 200 feet of subject prop- erty be reclassified 0-2, GENERAL COI~1EROIAL ZONE, and that the remainder of subject property be changed to R-3, ImL'l'IPLE FA!HLY RESIDENTIAL ZONE, upon the following conditions: ,-. , -'-. That Bluebell and Cliffwood Avenues remain closed, as at present. 2. That the owners of subject property deed to the City of Anaheim a strip of land 10 feet in width along Orangewood Avenue for street widening purposes. ). That the North-South street be extended southerly to the Mitchell property. That a 6-foot chain-link fence be constructed along the south boundary of subject property. That when subject property is developed, the rear wall of the garages to be constructed along the west property line be constructed of concrete masonry blocks and be a minimum of 8 feet in height. That any multiple-family dwellings constructed on the west side of the North-South Street be restricted to one-story dwellings; provided, however, that two- story dwellings may be built on any of these lots if the building design and construction is such that the line of Vision from any window in the second story of the dwellings is such that the plane of Vision is at least eight feet above the adjoining R-l property. 4. 5. 6. That the owners of' sub ject pro..:erty place of record appropriate 0-2 and R-3 Deed Restrictions covering the property in the respective zones; and that the R-3 restrictions limit the dwellings constructed on the West side of the North-South street to one- story; provided, however, that two-story dwellings may be built if the building design and construction is such that the line of vision from any window in the second story of the dwellings is such that the plane of vision is at least eight feet above the adjoining R-l property. 8. Said change of Zone shall not become effective unless within sixty days, or such further time as the Council may grant, the restrictions herein required to be imposed upon the property shall have 7. -2- c r , - "... been executed by the owners of the property, submitted to the City for approval and filed of record, nor until deeds for Street widening or utility purposes, when required, have been executed and delivered to the City. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and Qirected to prepare and sub~lt to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to am.end sD.id Anaheim Hunicipal Code to accomplish the object he'''ein found D.nd ~,etermined to be necessary and proper.
