A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING AND APPROVIln A RIGHI'
OF WAY COJITRACT TO BE MADE AJrn ENTERED INTO.
BY AND 'BETWEEN TIlE C.ITY OF ANAHEiM AND SEASIDE
OIL CCIIPANY.
WHEREAS, the City Council does find that Seaside
Oil Company is the owner of certain real property situated
in the City of Anaheim, County of Orange, State of Cali-
fornia, described as follows:
Lot Thirty (30) of Tract No. 255, "East Anaheim
Subdivision," in the County of Orange, State of
California, as per map thereof recorded in Book 14,
at Page 25, of Miscellaneous Maps, Records of
sai~ Or~nge County;
EXCEPTING THEREFROM the ~ast,rly 20 feet, for
Coffman Avenue, as conveyed to the County of
Orange, September 19, 1938.
,~D ~EAS, the City desires an easment for road
and utility purposes over, under and across a portion of
s~id property owned by said Seaside Oil Company, and said
company is willing to grant such easement upon the covenants
and conditions hereinafter ,set forth, and has this day sub-
mitted to the City an agreement granting to the City of
Anaheim such easement on the conditions therein specified,
which said agreement the City Council does find to be fair
and reasonable, and should be approved and its execution
authorized for and on behalf of the City of Anaheim.
NCNl, nrEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the right of way contract sub-
mitted to the City by said SeaSide Oil Company, providing
for the granting to the City of Anaheim of an easement for
road and pUblic utility purposes over, under and across the
Southerly 20.25 feet of the above described real property,
but reserving to said Seaside Oil Company, its successors
and assigns, the right of uninterrupted ingress and egress
over and across said easement to the remaining property of
said company subservient to said easement, and upon the
further condition that the City shall construct and install
curbs, gutters, a 24-foot drive opening opposite the exist-
ing fence gates of Seaside Oil Company facing Center Street
and pave Center Street, all at the sole cost and expense
of the City, be, and the same is hereby, approved; and that
the Mayor and the City Clerk be, and they are hereby, author-
ized to execute said right of way contract for and on behalf
of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed
by me this 14th day of May, 1957.
