A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM ACCEPTING A StALED PROPOSAL
AND AWARDING A CONTRACT TO THE LOWEST RES-
PONSIBLE BIDDER FOR THE FURNISHING OF ALL
PLANT, LABOR, SERVICES, MATERtALS AND EQUIP-
MENT AND ALL UTILITIES AND TRANSPORTATION,
INCLUDING POWER, FUEL AND WATJl;R, AND PER-
FORKING ALL WORK NECESSARY TO OONSTRUOT AND
COMPLETE THE FOLLOWING PUBLIC IMPROVEMENT:

WHEREAS, the City Council of the City of Anaheim did
oause to be published in a newsPaper of general oirculation,
printed, published and oiroulated in the Oity of Anaheim, to
wit: The Anaheim Bulletin, on the 2nd day d and 8th clay of May,
19 5l ,a notioe inviting sealed proposals for furnishing
the 011 owing:
All plant, labor, services, materials and equipment, and
all utilities and transportation, including power, fuel
and water, and performing all wotk necessary to construct
and complete, in a good and wor~nlike manner, in strict
accordance with the specifications, plans and drawings
therefor on file in the Office of the City Clerk or the
City Engineer of the City of Anaheim, the following public
improvaaent, to wit: The Improv$ment of Dale Street,
from Crescent Avenue to Lincoln Avenue, consisting of
excavation, paving with 4 inches of plant-mix, adjusting
existing manholes to grade, and appurtenant work as
indicated on the plans, Job No. 136,
in aocordance with the designs, plans, profiles and specifications
of said public improvement on file in the Office of the City Olerk
of the Oity of Anaheim; and
WHEREAS, said notice inviting sealed proposals for said
public improvement did prOVide that sealed proposals would be reoeived
by the City Council of the City of Anaheim at the Office of the City
Clerk of the City of Anaheim up to the hour of 7:00 o'olook P.M. on
the 14th day of Mav , 19.5Lfor the furnishing of all
plant, labor, services, materials and equipment, all utilities and
transportation, inoluding power, fuel and water, and performing all
work neoessary to construct and complete, in a good and workmanlike
manner, the public improvement hereinabove more partioularly mentioned
and desoribed and which notice did state and declare that pursuant
to the provisions of Section 1770 of the Labor Code, the City Council
of the City of Anaheim had ascertained the prevailing rate of wages
in the locality in which this type of labor is to be performed for
each oraft or type of workman or mechanic needed to exeoute the oon-
traot and did set forth the prevailing hourly wage scale so asoertained;
and

WHEREAS, the City Council of the City of Anaheim did receive
the following eealed proposals prior to 7:00 o'clook P. M. on the

afore.aid inviting sealed proposals, to wit:

WHEREAS, the Oity Oouncil did thereupon refer said bids to
the City E~iQeer tor examination, tabulation

did examine and tabulate said sealed proposals and d d report to the

WHEREAS, the Oity Oouncil finds that the sealed proposal 8ub-
mlt'ed by R. J. NOBLE COMPANY. P. O. Box 620. Oran~A. r,~11~n~n1a
is the lowest responsible proposal submitted for the furnishing of all
plant, labor, servioes, materials and equipment, all utilities and
transportation, inoluding power, fuel and water an4 performing all work
nece.sary to oonstruot and complete in a good and workmanlike manner
in 8~riot acoordance with the specifications, plans and drawings
therefor on file in the office of the Oity Olerk of the Oity of Ana-
heim of the public improvement hereinabove mentioned and desoribed,
together with the appurtenanoes thereto, and as apeoified in the
notioe inviting sealed proposals, and that said proposal of said
above named bidder should be accepted and a oontract awarded to said
bidder in aooordanoe therewith; and
WHEREAS, the Oity Council finds that the above mentioned
sealed proposal is the lowest responsible proposal received and that
the person, firm or corporation submitting said proposal is a
responsible person, firm or corporation and that the proposal sub-
mitted is the best suited and fitted for the public improvement to
be oonstruoted.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF TBJ:
CITY OF ANAHEIM, that the sealed proposal submitted by
R. J. NOBLE r,ONWANY
for the furnishing of all plant, labor, servioes, materials and
equipment, all utilities and transportation, inoluding power, fuel
and water and performing all work necessary to oonstruot and oomplete
in a good and workmanlike manner, in strict aocordanoe with the
speoifioations, plans, and drawings therefor on file in the offioe
ot the Oity Olerk of the Oity of Anaheim and the notioe invitin;
sealed proposals, the publio works and improvements hereinabove more
partioularly mentioned and described, together with the appurtenanoes
thereto, be, and the same is hereby, aocepted, and that a contraot
for the oonstruction and completion of said public improvement be,
and the same is hereby, awarded to the said above named bidder.
AND BE IT FURTHER RESOLVED that the suooessful bidder or
bidders upon eaoh oontract awarded as hereinabove set forth shall
be, and they are hereby required to exeoute a oontraot in the required

form with the City of Anaheim upon the terms and oonditions speoified
in the notioe inviting sealed proposals and the proposal submitted
by said suooessful bidder or bidders and in aooordanoe with the plans
and specifioations for said public improvement hereinabove desoribed
and in acoordanoe with the terms, conditions and provisions of this
resolution, and that said successful bidder or bidders to whom each
oontraot is awarded shall be required to furnish a surety bond in an
amount equal to one hundred per cent (lOO~) of the oontract price for
all labor, materials and equipment to be furnished and performed as
set forth in the sealed proposals!3ubmitte4 by sa-fd bidder for the
construction of said public improvement together with the appurtenances
thereto or suoh portion thereof as is oovered by said oontraot as
seourity for the faithful performanoe of said contract and a separate
surety bond in an amount equal to one hundred per cent (lOO~) of the
construc~on cost of said public improvement oovered by said oontract
as sec~ity for the payment of all persons perform~ng labor and furn-
ishing material for said project.
AND BE IT FUR!HER aEBOLVED that said successful bidder or
bidders be, and they are hereby required to furnish to the Oity ot
Anaheim in oompanies satisfactory to the City ot Anaheim publio
liability, property damage, oompensation, and. other insuranoe in
the amounts and for the purposes as set forth and specified in the
notioe inviting sealed proposals and subJeot to the approval of the
City Attorney as to form and sufficienoy.
AN!> BE IT FURTHER RESOLVED that the Mayor and the City Olerk
of the Oity of Anaheim be, and they are hereby, authorized and directed
to make, execute and enter into for'and on behalf of the City of Ana-
haim a written contract with said sucoessful bidder or bidders for the
furnishing of all plant, labor, materials, and equipment and performimg
all work as hereinabove more partioularly described for the oonstruc-
tion, installation and completion of said pUblio improvement herein-
above desoribed upon the terms and oonditions as speoified in the
notioe inviting sealed proposals, the detailed design, plans, profiles,
drawings and general speoifications and detailed speoifioations and
drawings and all addenda thereto and all modifications incorporated
therein prior to the date of the opening of bids, on file in the offioe
of the Oity Olerk of the City of Anaheim and in striot accordanoe with
the terms, conditions and prOViSions of this Resolution, and in aocord-
anoe with all the contract documents herein specified.
THE FOREGOING RESOLUTION is signed and approved by me this
14th day of May , 195--1--.
