57R-3868 - - ,,-., RESOLUTION NO. 3868 A RESOLUTION OF THE CITY COONCIL OF THE CITY OF A.NA.UUI AMENDING RESOLlin'IOJI NO. 3729 RE- LATING 10 ACHAHGE OF ZONE IN CERTAIN AREAS OF THE CITY. WHEREAS, heretofore, to wit, on the 12th day of March, 1957, the City Council did doptResolution No. 3729 finding aad deter.ining that the prlllperty described in said resolution should be changed from the cIa ssification of R-A, Residential-Agricultural Zone, to C-3, Heavy Commercial, and C-l, Neighborhood Commercial Zones, as more particularly set forth in said resolution; and WHEREAS, said resolution did further prOVide, as a condition incident to said reclassification, that the owners of said property should deed to the City of Anaheim a strip ot land 10 feet in depth along Lincoln Avenue for street widening purposes; and WHEREAS, the City Council does find upon further investigation that the provision requiring the dedication of a strip of land 10 feet in depth along Lincoln Avenue for street widening purposes should be eliminated from said resolution, and that inasmuch as Lincoln Avenue is a State Highway, arrangem~nts should be made with the State Highway Department regarding that portion of the frontage on Lincoln ~enue required for street widening purposes; and WHEREAS, the City Council does further find that as a result of the objection to said provision in said resolution, an ordinance has never been adopted directing said change of zone and completing said proceeding. NCJN, THEREFORE, BE IT RESOLVED by the Ci ty Council of the City of ~heim that Resolution No. 3729, heretofore adopted on March 12, 1957, be, and the same is hereby, aaended as follows: That Condition No.3, reading as follows: "3. That the owners of subject property deed to the City of Anaheim a strip of land 10 feet in depth along Lincoln Avenue and a strip of land 40 feet in depth along Dale Avenue for street Widening purposes." ,--. be changed to read: "3. That the owners of subject property deed to the City of Anaheim a strip of land 40 feet in width along Dale Avenue, measured from the center line thereof, for street widening purposes, and make arrangements with the State Highway Department regard- ing that portion of the frontage along Lincoln Avenue required for street widen- ing purposes." -1- r~.dZ -.57~ /.5- -. - .~ AND BE IT FURTHER RESOLVED that in all other re- spects said Resolution No. 3729 be and remain in full force and effect. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim MUnicipal Code to accomplish the object herein found and determined to be necessary and proper.
