A RESOLUTION OF THE CITY C~NCIL OF THE CITY OF ANAHEIM INITIATING PROC EDINGS FOR THE ANNEXATION OF CERTAIN UNIN ITED TERRITORY TO THE CITY OF ANAHEIM, ONI ITS OWN MOTION; DESIGNATING THE TERRITORY ~S THE EUCLID- LA PALMA NO.2 ANNEXATION; I DESCRIBING THE BOUNDARIES OF THE TERRITOBt PROPOSED TO BE ANNEXED AND GIVING NOTICE OF THE DAY, HOUR AND PLACE WHERE AND WHEN A~ PERSON OWNING REAL PROPERTY ~HTHIN SUCH !rERRITORY SO PROPOSED TO llE .ANNEXED MAY ~PEAR BEFORE TEE CITY COUNCIL AND SHOW CAUSt WHY SUCH TERRITORY SHOULD NOT BE ANNEXED TO TEE CITY OF ANAHEIM. WHEREAS, the City Counci~ bf the City of Anaheim has investigated certain uninhabited territory as hereinafter set fort. and does find that such territory is so situated as to require facilities of the City of' Anaheim to pass through such territory, and does find that s~ch territory can be easily served with the facilities of the City of Anaheim and does further find that service of other areas in the City of Anaheim will be facilitated by annex~tion of such uninhabited territory, and that annexation of sUOh territory will be in the best interest of the City of Anaheim and the best interest of' the area to be annexed; and WHEREAS, the City Council does hereby determine that proceedings for the annexation of the hereinafter described uninhabited territory should be initiated by the City Council on its own initiative; and WHEREAS, the proposal for the annexation of the territory hereinafter described to the City of Anaheim was submitted to the Boundary Commission of the County of Orange, State of California, and reported upon by said Boundary Commission with respect to the definiteness and certainty of the proposed boundaries; and WHEREAS, said territory proposed to be annexed to said City of Anaheim is situated in the County of Orange, state of California and is contiguous to the City of Anaheim and is uninhabited territory; and WHEREAS, the City Council finds from evidence and reports received that said new territory proposed to be annexed to said City of Anaheim does not form a part of any municipal corporation and that said territory is uninhabited and is contiguous to the City of Anaheim; and WHEREAS, the City Council finds that the boundaries of the territory so proposed to be annexed to the City of Anaheim are as follows, to wit: ".......... A parcel of land located p~rtly in the Northeast quarter (NEt) of Section 8 and partly in the Northwest quarter (NW~) of Section 9 of Township 4 South, Range 10 West, S.B.B.&M. described as follows: Beginning at a point on the existing City limits -1- - - r"" line of the City of Anahei~ as established by the Euclid-La Palma Annexa~ion to the City of Anaheim, approved by Ordin~nce No. 866 on November 10, 1953, and fil~d with the Secretary of State on December 14, 1~5J, said point also being 30 feet Southerly as! measured at right angles from the North linei and 30 feet Easterly as measured at right angleis from the West line of said Section 9, thence, L Southerly along said Ciity limits line 1030.)6 feet, more or less, to thei point of intersection with the Easterly prolong~tion Of the South line of Tract No. 3008 as shown on a map filed in Book 94, Page 1 of MiscellaneoUs Maps in the Offioe of the County Recorder of Or~nge County, California, thence, 2. Westerly along said Easterly prolongation 30 feet to a point, said point being in the East line of said Section 8, thence, 3. Continuing Westerly aloing the South line of said Tract No. 3008, 661.33 feet, more or less, to a point, said point being in the existing City limits line of the City of Ana.heiim as established by the West La Palma Annexation ~o. 3 approved by Ordinance No. 902 on June 9, 1954 and filed with the Secretary of state on July 13, 1954, thence, 4. Northerly along las t me,n tioned City limi ts line as established by the Houston Avenue Annexation and approved by Ordinance No. 830 on January 13, 1953, and filed with the Secretary of State on February 24, 1953, thence, 5. Easterly along the last mentioned City limits line 692 feet, more or less, to the point of beginning. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM: ~. That the proposed annexation be and it is hereby initiated on the motion of the City Council of the City of Anaheim and that such proposed anne~ation be designated as "EUCLID -LA PALMA NO. 2 ANNEXATION" and that notice of such pro- posed annexation be hereby given as hereinafter provided. BE IT FURTHER RESOLVED that a public hearing shall be had upon the date set, not less than forty (40) nor more than sixty (60) days after the passage of this Resolution, unless the owner or owners of all of the territory to be annexed have filed their consents to such annexation, in writing, with the City Council, in which event the hearing shall be set not less than fifteen (15) days nor more than sixty (60) days after the passage of this Resolution. AND BE IT FURTHER RESOLVED that the City Council does find that the owner or owners of all of the territory -2- - ,- ,.,-... proposed to be annexed have filed their consents to such annexation, in writing, wit~ the City Council. BE IT FURTHER RESOLVED thait the l:ltA day of J~ , 19 51 ,at the hour pf 1tw.-_~rC10Ck P. M., at the City Council Chambers! in the lty Hall of ~City of Anaheim be, and the samel is herebY, fixed as the day, hour and place when and whe~e the City Council will hear protests made by any owne~ or owners of real property within the territory propos~d to be annexed; and tb.a.t at any time before the hour seti for hearing objections, any owner of property within said te~ritory may file with the City Clerk a written protest aga~nst the annexation. Said protest shall be in writing an~ shall state the name of the owner of the property affected and the description and area of the property in general terms. BE IT FURTHER RESOLVED tha~ the City Clerk be, and she i8 hereby, authorized and directed to cause a copy of this Resolution to be published a~ least twice, but not oftener than once a week, in a newsp~per of general circula- tion, published in the City, to wit: The Anaheim Bulletin of Anaheim, Orange County, California, ~nd also in a newspaper of general circulation, published ou~side of the City, but in the CQunty of Orange, in which is. located the territory hereinabove proposed to be annexed tb the City of Anaheim, to wit: The Placentia Courier of Plabentia, Orange County, California; and that such publication shall be completed at least twenty (20) days prior to the date of hearing herein- above specified. AND BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be, and she is hereby, authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed, in the last equalized county assessment roll available, on the date the proceedings were initiated, at the address sho\~ on said assessment roll or as known to said City Clerk, and to any person who has filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with said Clerk; and in the event that land within the territory proposed to be annexed to the City of Anaheim is owned by a County, the City Clerk of the City of Anaheim shall also cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such County. The foregoing notices shall be given not less than twenty (20) days before the first public hearing on the proposed annexation.
