A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM ACCEPTING A SEALED PROPOSAL
MID AWARDIHG A CONTRACT TO THE LO\'JEST RESPON-
SIBLE BIDDER FOR T:H:2 FURNISHING TO THE CITY OF
ANAHEIIvl OF REINFORCED CONCRETE STEEL CYLINDER
PIPE AND FITTINGS, WORK ORDER NO. 1485.
WHEREAS, the City Council of the City of Anaheim did
cause to be published in a newspaper of general circulation,
printed, published and circulated in the City of Anaheim, to wit,
the Anaheim Bulletin, on the 18th and 25th days of April, 1957,
a notice inviting sealed proposals for the furnishing to the City
of Anaheim, in aoproximate quantities, of the following reinforced
concrete cylinder pipe and fittings, including rubber gaskets for
installa tion:

the following: Pipe shall be Class 150 for 150 pounds maximum

sealed proposals would be received by the City Council of the

up to the hour of 7:00 o'clock P. 11. on Wednesday, the 1st day
of May, 1957, for the furnishing to the City of Anaheim of said
pipe, fittings and gaskets; and

'NHEREAS, the City Clerk of the City of Anaheim did
receive sealed prooosals prior to 7:00 o'clock P. M., Wednesday,
the 1st day of lilay, 1957, for the furnishing of said reinforced
concrete steel cylinder pipe and fittings, including rubber gaskets
for installation, from the following persons, firms or corporations:

AND WHEREAS, the City Council did thereupon submit all
bids received to the City Engineer for tabulation and report to
the City Council, and salct Ci ty Engineer having tabulated said bids
and having submitted his report, the City Council does find that
the sealed proposal of American Pipe and Construction Co., P. O.
Box 3428, Terminal Annex. Los Angeles 54, California, is the lowest
responsible biQ for the furnishinc of reinforced concrete steel
cylinder pipe and fi-:;tings, includin~: rubber gaskets for installation,
as specified in the notice inviting sealed proposals and in accord-
ance with the s!)ecificaticns set forth in said notice inviting
sealed proposals, and that said proposal of American Pipe and
Construction Co., should be Ei.ccepted and a contract awarded to said
company for furnishing the pipe, fittings and gaskets required by
the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City Of Anaheim that said proposal submitted by the American
Pipe and Construction Co. for the furnishing of reinforced con-
crete steel cylinder pipe and fittings, including rubber gaskets
for installation, as specified in the notice inviting sealed
proposals therefor, and in accordance with the specifications
set forth in saiel notice inviting sealed proposals, be, and the
s~ne is hereby, accepted, and that a contract for the furnishing
of said pipe, fittings and gaskets be, and the same is hereby,
awarded to said American Pipe and Construction Co.; and

BE IT FURTHER RESOLVED that the award of a contract
to said American Pipe and Construction Co. is declared to be for
the approximate quantities set forth in the notice inviting
sealed proposals; and

BE IT FURTHER RESOL~ED that said American Pipe and
Construction Co., be, and it is nereby, required to execute a
concract for the furnishing of said pipe, fittings and gaskets,
in form satisfactory to the City of Anaheim and upon the terms
and conditions specified in the notice inviting sealed proposals,
the proposal submitted by it, this resolution, and in accordance
with the specifications for reinforced concrete steel cylinder
pipe and fittings as set forth in said notice inviting sealed
proposals, in all required sizes and lengths, at the prices as

AND BE IT FURTHER RESOLVED by the City Council of the
City of Anaheim that said bid be, and the same is hereby, accepted
and said contract awarded for the above specified reinforced con-
crete steel cylinder pipe and fittings, including rubber gaskets
for installation, F.G.B. mill or pOint of shipment, with freight
allowed to trenchside, Anaheim, California, said pipe, fittings
and gaskets to be delivered as follows:
The design and layout drawings to be presented within
two weeks from receipt of plans and profile, and deliveries of
said pipe and fitting s to be made ,vi thin fifty (.50) days after
anproval of layout drawings and receipt of order; and

BE If FURTHER RESOLVED that said contract shall contain
a provision that should said American Pipe and Construction Co.
fail or neglect to furnish said concrete steel cylinder pipe,
gaskets and/or fittings in accordance with said specifications
and the proposal submitted by it and accepted by the City of
Anaheim within the time herein specified, it shall, in addition
to any other penalties provided in the contract documents, be

liable to the City of Anaheim for all loss or damage that the
latter may suffer on account thereof.
THE ?OREOOING HESOLUTION is signed and approved by
me this 1st day of May, 1957.
