WHEREAS, the Oity Oounoil of the City of Anaheim did
cauee '0 be published in a newspaper of general oiroulation,
printed, published and oiroulated in the City of Anaheim to
vU: The An~e1m Bulletin, on the~day .cand lsih daY,of April,
19~7 , a not10e inviting sealed propo.als for furnishing
the tollow1ng:
All plant, labor, services, materials and equipment, and all
utilities and transportation, including power, fuel and water,
and performing all work necessary to construct and complete
in a good and workmanlike manner, in strict accordance with
the specifications, plans and drawings therefor on file in the
Office of the City Clerk of the City of Anaheim, the following
public improvement, to wit: The Dale Avenue Sewer Improvement,
consisting of the construction of a V.C.P. sewer lateral in
Dale Avenue from Lincoln Avenue to Crescent Avenue, including
trenching, manhole construction, backfill, jaoking, and appurten-
ant work as indioated on the plans, Job No. 1090,
in &ooordanoe with the designs, plans, prOfiles and speoifioations
of said publio improvement on file in the Office of the Oity Olerk
of the Oity of Anaheim; and
WHEREAS, said notice inviting sealed proposals for 8ald
pUblio improvement did provide that seal~d proposals would be reoeived
by the Oity Council of the Oity of Anahe1m at the Office of the Oity
Olerk of the City of Anaheim up to the hGur of 7:00 o'clock P.X. on
the 23rd day of April , 195..1....for the furnishing of all
plant, labor, services, materials and equipment, all utilities and
tranaportation, inoluding power, fuel and water, and perfora1ng all
vork neoessary to construot and complete, in a good and workmanlike
manner, the public improvement hereinabo~e more partioularly ment10ned
and desoribed and which notioe did state and deolare that pursuant
to the provisions of Seotion 1770 of the Labor Code, the Oity Oounoll
of the City of Anaheim had ascertained the prevailing rate of wage.

WHEREAS, the 01ty Oounoil tinds that the sealed proposal sub-

is the lowest responsible proposal submitted tor the furnishing of all
plant, labor, servioes, materials and equipment, all utilities and
transportation, inoluding power, fuel and water an4 performing all work
nee.ssary to oonstruot and complete in a good and workmanlike manner
in striot acoordance with the specifications, plans and drawings
ther.tor on tile in the office of the Oity Olerk of the City ot Ana-
heim of the publiC improvement hereinabove mentioned and desoribed,
together with the appurtenanoes thereto, and as speoified in the
notioe inviting sealed proposals, and that said proposal of sa14
above named bidder should be accepted and a oontraot awarded to said
bidder in aooordanoe therewith; and
WHEREAS, the City Council finds that the above mentioned
sealed proposal is the lowest responsible proposal received and that
the person, firm or corporation submitting said proposal is a
responsible person, firm or oorporation and that the proposal sub-
mitted is the best suited and fitted for the publio improvement to
be oonstruoted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OOUNCIL OF THB:
CITY OF ANARlIM, that the sealed proposal submitted by ELMER E.
R~RNF.TT. 1;1~2 Centurv Boulevard. Garden Grove. Oalifornia
for the furnishing of all plant, labor, services, materials and
equipment, all utilities and transportation, inoluding power, fuel
and water and performing all work necessary to oonstruct and oomplete
in a good and workmanlike manner, in striot aooordanoe with the
speoifioations, plans, and drawings therefor on file in the office
ot the Oity Olerk of the City of Anaheim and the notioe inviting
sealed proposals, the publiC works and improvements hereinabove more
partioularly mentioned and desoribed, together with the appurtenanoes
thereto, be, and the same is hereby, aocepted, and that a oontraot
for the oonstruotion and oompletion of said public improvement be,
and the same is hereby, awarded to the said above named bidder.

AND BE IT FURTHER RESOLVED that the suooessful bidder or
bidders upon each oontraot awarded as hereinabove set forth shall
be, and they are hereby reqUired to execute a oontraot in the required

form with the City of Anaheim upon the ~erms and oonditions speoified
in the notice inviting sealed proposals and the proposal submitted
by .aid successful bidder or bidders and in aooordanoe with the plans
and specifioations for said pUblio improvement hereinabove desoribed
and in acoordanoe with the terms, oonditions and provisions of this
resolution, and that said suocessful bidder or bidders to whom eaoh
oontraot is awarded shall be required to furnish a surety bond in an
amount equal to one hundred per cent (100%) of the contraot prioe for
all labor, materials and equipment to be :f"'urnished and performed as
set forth in the sealed proposals submitted by said bidder for the
construotion of said pUblio improvement together with the appurtenanoes
thereto or suoh portion thereof as is covered by said oontract as
seourity for the faithful performanoe of said contract and a separate
surety bond in an amount equal to one hundred per oent (100%) ot the
oonstrucUion cost of said'public improvement covered by said oontract
as seourity for the payment of all persons performing labor and furn-
ishing material for said proJeot.
AND BE IT FURTHER'RESOLVED that said suooessful bidder or
bidders be, and they are hereby required to turnish to the City ot
Anaheim in companies sat 1sfaotoryto the Oity of Anaheim publio
liability, property damage, compensation, and other insuranoe in
the amounts and for the purposes as set forth and speoified in the
notioe inviting sealed proposals and subJeot to the approval ot the
City Attorney as to form and suffioienoy.

of the Oity of Anaheim be, and they are hereby, authorized and direoted
to make, exeoute and enter into for and on behalf of the Oity of Ana-
~1m a written oontract with said sucoeSsful bidder or bidders for the
furnishing of all plant, labor, materials, and equipment and performing
all work as hereinabove more partioularly described for the construo-
tion, installation and completion of said publio improvement herein-
above desoribed upon the terms and oonditions as specified in the
notioe inviting sealed proposals, the detailed design, plans, profiles,
drawings and general speoifications and detailed specifications and
drawings and all addenda tnereto and all modifications incorporated
therein prior to the date of the opening of bids, on file in the office
of the Oity Olerk of the City of Anaheim and in strict aooordanoe with
the terms, oonditions and provisions of this Resolution, and in aocord-
anoe with all the contract doouments herein speoified,
