57R-3814 - -~j~) .....~ - ~-- "--"'--- RESOLUTION NO. 3814 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING ITS I_TENTION TO CALL b SPECIAL ELEOTION TO SUBMIT TO THE QUALIFIED ELECTORS RESIDING IN THE H~INAFTER DE:;" SCRIBED TERRITORY THE QUESIION OF ANNEXATION OF SAID TERRITORY TO THE C TY OF ANAHEIM. 1JJM. · filed a written request with the Cit~ Counoil of the City of Anaheim requesting the oonsent of the City Counoil to the oommenoement of prooeedings for the ~nnexation of certain in- habited territory, more particularly hereinafter described, to the City of Anaheim pursuant to the provisions of the Annexation Act of 1913 (Title IV, Division 2, Part 2, Chapter 1, Artioles 1 to 4 inolusive, of the Government Code of California); and ~~EREAS, the City Council did on the 6th day of ~arch , 19 57 ,referaaid request and applicat- ion 0 the City Planning Commission; and vlliEREAS, on the 6th day of March , 19 ?7 , the City Council did receive from the City Planning Comaission its recommendation approving the proposed annexation; and ~ iI - '~EREAS, the proposal for the annexation of said territory to tbe City of Anaheim has peen submitted to the Boundary OOmmission of the County of Orange for ita report to the proponents with respect to the definiteness and certainty of the proposed boundaries; that said Boundary Commission has (has not) reported upon the petition or proceedings within twenty (20) days after it was submitted to it; and 'oTHEREAS, said City Counoil did, on the 6th day of March ,1957, adopt Resolution No, 3719 giving its consent to the commencement of said annexation pro- ceedings and approving the circulation of a petition for the annexation of said territory to the City of Anaheim; and W'HEREAS, on the 12th day of March , 19 r57 , said proponents did publish a notice of intention to circulate a petition for the annexation of the hereinafter de- scribed property to the City of Anaheim, and within ten (10) days thereafter did file with the City Clerk of the City of Anaheim,a oopy of suoh notioe of intention to circulate a petit- ion for the annexation to the City of Anaheim of said territory, which notice contained the names of the proponents intending to circulate the petition and the specific boundaries Qt the terr- itory proposed to be annexed, accompanied by a printed state- ment, not exceeding five hundred (500) words in length, contain- 1ng reasons for the petition, together with an affidavit of the publication of said notice of intention to circ~late said petition; and JHEREAS, within fifteen (15) days after the filing of said notioe of intention to ciroulatesaid petition, acoompanied by said affidavit of publication, the City Council did, on the --12.tJl day of March I 19 57 ,adopt Resolution ~39 finding and determining that~ould be to the ad van- tage-ina for the best interest of the City of Anaheim and the qualified electors residing within the hereinafter described territory, to approve the circulation of a petition for the -1- '. ,~ ;X'i,_,;.i;'~_":..",:.ol-.."""."-->~'c-~"::"'" ", ! Piepenbrink ,J -"....... ~ ~ ,.-., /-, annexation of said territory to the City of Anaheim and did there- upon approve the circulation of said petition; and WHEREAS, on the 16th day of April , 19-i7, the City Counoil did reoeive a petition signed by not less than one-fourth of the q~lified eleotors residing within the territory hereinafter deeorib.., as lhown by the County Registration of Voters, oontaining a desorintion ot t~e new territory proposed to be annexed to the City of Anabelm &Di asking that said territory be annexed to the City; and the Clty Oounol1 does find and de- termine that said proponents have done and performed the acts and things required to be done and performed by the Annexation Aot of 1913, at the time and in the manner as required by the pro- vlsions of said Aot; and that said petition was circulated more than twenty-one (21) days after the publioation of notice of in- tention to oirculate suoh petition and that it is signed by not less than one-fourth of the qualified electors residing within the territory proposed to be annexed, as shown by the County Registration of Voters and as appears from the oertificate of the City Clerk ot the City of Anaheim presented to the City Counoil at the time of consideration of said petition and prior to the adoption of this resolution; and does further find that more than twelve (12) qualified electors resided within the boundaries of the territory proposed to be annexed at the time of the filing ot said petition for said anneXation; and does further find, from evldence and reports received and from said petition, that at the time of the filing and presentation of said petition, that lald new territory proposed to be annexed to said City of Anaheim dld not form a part of any other clty or municipal oorporation, and that sald territory was, at the time of tiling said petition inhabited territory and is contiguous to the City of Anaheim; and WHEREAS, the Clty Council does further find that it would be to the advantage and for the best interests ot the City of Anaheim, and the residents thereof, and the qualified eleotors residing within the territory proposed to be annexed, as herein- after more particularly described, to submit the question of the annexation of said territory to the City of Anaheim to the elect- ors residing within said territory; and WHEREAS, the City Council does further find that said territory ~hould be designated by some appropriate name by which it may be referred to upon the ballots used at the eleotion at which the question of annexation of said territory to the City of Anaheim shall be submitted to the electors residing within said territory and that an appropriate designation for such territory is "NmTHF.A.ST ANNEXATION NO. 2-A" ~Ib.; and -WHEREAS, the City Council finds from said petition and evidence and reports received that the boundaries of the territory so proposed and sought to be annexed to the City of Anaheim are .. follows, to-wit: Said territory 1s situated in the County of Orange, State of California, and the specific boundaries thereof are as follow.: -2- --,. "..- -- ,-.. -......- - NORTHEAST ANNEXATION NO. 2-A A parcel of land located in the County of Orange, State of California, and more particularly described as follows: Beginning at an angle point in the existing City Limits Line of the City of Anaheim as established by the Northeast Annexation of the City of Anaheim, passed by Ordinance No. 1108 on December 6, 1956, and filed with the Secretary of State on January 8, 1957, said point being the Southeasterly corner of Lot 8, Block 9 of the Golden State Tract as shown on a map filed in Book 4, Page 66 of Miscellaneous Maps in the office of the County Recorder of said Orange County; thence, 1. Easterly along the Southerly line of Lot 7 of Block 9 of said Golden State Tract, to a point, said point being the Southwest corner of Tract No. 1067 as shown on a map filed in Book )4, Page J4 of Miscellaneous Maps in the office of said County Recorder; thence, 2. AND BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be, and she is hereby, authorized and directed to cause a copy of this resolution to be published at least once a week for two weeks prior to the date hereinabove fixed for the hearing of protests and objections to said election and the annexation of said territory to the City of Anaheim, in the ANAHEIM BULLETIN, a newspaper of general circulation, published and circulated in the City of Anaheim, County of Ora'l ge, State of California.
