57R-3805 - .........- RESOLUTION NO. ~ ~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOllUTION NO. 3657, AND FINDING AND DETERMINING 1!HAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AAEAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHaJl.D BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Plannl~g Commission of the City of Anaheim has heretofore duly passed and adopted a resolu- tion declaring its intention to change the boundaries of the zone or zones hereinafter mentioned and described, and did fix a time and place for the holdi~g of a public hearing thereon in the manner and as p~escribed in Article IX, Chapter 2 of the Anaheim MUnicipal Code, and did duly hold and con- duct a public hearing to consider such proposed change of zone or zones and did receive evidence and reports from per- sons Interested therein; and WHEREAS, within a period of forty (40) days follow- ing the final hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for recommending an amend- ment to said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed changes of the boundaries of the zone hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommenda- tion of the City Planning Commission, the City Council did thereupon fix the 15th day of January, 1957 as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed change of zone and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Munici- pal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all persons interest.d therein an opportunity to be heard and did receive evidence and reports and did thereupon consider the recommendations of the City Planning Commission; and WHEREAS, the City Council did heretofore adopt Resolution NO. 3657 finding and determining that the property and area described In said Resolution No. 3657 should be changed to the zones as set forth in said resolution; and ,,.-... WHEREAS, the City Council does find that since the adoption of said resolution a revised tentative map of Tract No. 3084 has been filed covering only Lots 11 to 15, both In- clusive, of said Tract No. 3084 as shown on the original tentative map thereof, and renumbering said lots from 1 to 5, both inclusive; and ~REAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which It is now situated to a different zone as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the In- clusion of said property and area in such new zone or zones will increase the value of said property and area and will not de- preciate the values of property in adjoining zones. -1- l-56-57-31 - ,-. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anahei m, County of Orange, State of California, described as follows, to wit~ Lots 11 to 15, both inclusive, on the original tentative map of Tract No. 3084, now shown as Lots 1 to 5, both inclusive, on the revised map of Tract No. 3084, be changed from R-A, RESIDENTIAL-AGRICULTURAL ZONE, to the following zones, upon the conditions hereinafter set forth: That Lots 1 and 2 on the revised map of Tract No. 3084 (designated as Lots 11 and 12 on the origi- nal tentative map of Tract No. 3084) be changed to C-l, NEIGHBORHOOD COMMERCIAL ZONE; and that the remainder of said lots, being Lots 3, 4 and 5 on the revised map of Tract No. 3084 (designated as Lots 13, 14 and 15 on the original tentative map of Tract No. 3084), be changed to M-l, LIGHT MANUFACTIJRING ZONE, subject to the following conditions: 1. That the owner of subject property place of record appropriate C-l and M-l deed re- strictions as required by the City of Anaheim and approved by the City Attorney, for the respective uses of the land. 2. That all engineering requirements of the City of Anaheim be complied with as required by the City Engineer. AND BE IT FURTHER RESOLVED that Lots 1 to 10, both inclusive, as shown on the original tentative map of said Tract No. 3084, be changed from R-A, RESIDENTLAL- AGRICULTURAL ZONE, to the following zones, upon the condi- tions hereinafter set forth~ That Lots 1, 2, 9 and 10 be changed to C-l, NEIGHBORHOOD COMMERCIAL ZONE, and that the remainder of said lots, being Lots 3, 4, 5, 6, 7 and 8, be changed to M-1, LIGHT MANU- FACTURING ZONE, subject to the following conditions: /".,..,.. 1. That the owner of subject property place of record appropriate C-1 and M-l deed restric- tions as required by the City of Anaheim and approved by the City Attorney, for the re- spective uses of the land. 2. That all engineering requirements of the City of Anaheim be complied with as required by the City Engineer. 3. That said change of zones shall not become effective until such time as a final map is filed covering said Lots 1 to 10, both in- clusive. -2- ~ j - - r"- BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend saId Ana- heim MunIcipal Code to accomplish the object herein found and determined to be necessary and proper.
