,iHEREAS, the City Council of the City of Anaheim did
cause to be published in a ne~vspaper of general circulation,
printed, published and circulated in the City of Anaheim, to wit:

~pri_1J_).,957 __.' a notice inviting sealed proposaTS for
furnishing the Jrollowing:
All plant, labor, services, materi~ls and equipment,
and all utilities and transportation, including power,
fuel and water, and performing all work necessary to
oonstruct and complete in a good and workmanlike manner,
in strict accordance with the specifications, plans and
drawings therefor on file in the Office of the City Clerk
of the City of Anaheim, the following pUblic improvement,
to wit: The Brookhurst street Sewer Improvement, consist-
ing of the construction of a V.C.P. sewer lateral in
Brookhurst Street from Broadway to 1050 feet South of
Broadway, including trenohing, man~ole cons truotion , back-
fill, remodeling of an existing standard manhole to a drop
manhole, resurfacing and appurtenant work, as indicated on
the plans, Job No. 1095,
in accordance with the designs, plans, profiles and specifications
of said public improvement on file in the Off3 ;e of the City Clerk
of the City of Anaheim; and

)~blic improvement did provide that sealed pro osals would be re-
ceived by the City Council of the City of Anah 'em at the Office of
the City Clerk of the City of Anaheim up to tht hour of 7:00 O'clock
P.~.. on the 9th day of !lprll __, 195L_for the furnishing
of all plant, labor, services, materials and equipment, all utili-
ties and transportation, including power, fuel and vlater, and per-
forming all work necessary to construct and complete, in a good anc
"orkmanlike manner, the public improvement hereinabove more particu-
larly mentioned and described and which notice did state and declare
thet .Jursuant to the -orovisions of Section 1770 of the Labor Code,
the City Council of the City of Anaheim had ascertained the prevailing
rate of Hages in the locality in which this type of labor is to be pe1-
formed for each craft or tYlJe of Horkman or mechanic needed to execute
the contract and cUd set forth the prevailing hourly wage scale so
ascertained; and

WHERIAS, the Oity Counoil did thereupon refer said bids to
the Oitv E~~.r tor examination, tabulation
and report to the Oity Oounoil, and said Oity En~ine.r
did examine and tabulate said sealed pro~o8als and did report to the
OOQROil the result of his examination and tabulation; and
WHEREAS, the Oity Oounoil finds that the sealed proposal sub-
mitted by J, P, S. CONTRACTING COMPANY, INC. 12084 Westminster Blvd,
Santa Ana, California
is the lowest responsible proposal submitted for the furnish1ng of all
plant, labor, servioes, materials and equipment, all utilities and
transportation, inoluding power, fuel and water and performing all work
necessary to oonstruot and complete in a good and workmanlike manner
in striot acoordance with the speoifications, plans and drawings
theretor on file in the office of the City Olerk of the Oity of Ana-
heim of the publio improvement hereinabove mentioned and desoribed,
together with the appurtenanoes thereto, and as apeoitied in the
notioe inviting sealed proposals, and that said proposal of said
above named bidder should be accepted and a oontraot awarded to said
bidder in aooordanoe therewith; and
WHEREAS, the City Council finds that the above mentioned
sealed proposal is the lowest responsible proposal reoeived and that
the person, firm or corporation submitting said proposal is a
responsible person, firm or corporation and that the proposal sub-
mitted is the best Buited and fitted for the public improvement to
be oonstructed.

NOW, THJ:REFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THB:
CITY OF ANAHEIM, that the sealed proposal submitted by
J. P. S. CONTRACTING COMPANY. INC. 12084 Westminster Blvd.
Santa AnA. California
for the furnishing of all plant, labor, services, materials and
equipment, all utilities and transportation, inoluding power, fuel
and water and performing all work neoessary to oonstruot and oomplete
in a good and workmanlike manner, in striot aocordanoe with the
specitioationa, plans, and drawings therefor on tile in the offioe
ot the Oity Olerk of the City of Anaheim and the notioe inviting
sealed proposals, the publio works and improvements hereinabove more
~artioularly mentioned and described, together with the appurtenanoes
thereto, be, and the same is hereby, accepted, and that a oontraot
for the oonstruotion and oompletion of said public improvement be,
and the same is hereby, awarded to the said above named bidder.
AND BE IT FURTHER RESOLVED that the sucoessful bidder or
bidders upon eaoh contraot awarded as hereinabove set forth shall
be, and they are hereby required to exeoute a contraot in the required

form with the City of Anaheim upon the terms and oonditions speoified
in the notioe inviting sealed proposals and the proposal submitted
by said successful bidder or bidders and in accordance with the plans
and specifications for said public improvement hereinabove desoribed
and in accordance with the terms, condit1.ons and provisions of this
resolution, and that said successful bidder or bidders to whom each
contraot is awarded shall be required to furnish a surety bond in an
amount equal to one hundred per cent (100%) of the contraot price for
all labor, materials and equipment to be furnished and performed as
set forth in the sealed proposals submitted by said bidder for the
construction of said pUblic improvement together with 'the appurtenances
thereto or such portion thereof as is covered by said contract as
seourity for the faithful performanoe of said oontraot and a separate
surety bond in an amount equal to one hundred per cent (100%) of the
construction cost of said public improvement covered by said oontraot
as security for the payment of all persons performing labor and furn-
ishing material for said project.
AND BE IT FURTHER RESOLVED that said successful bidder or
bidders be, and they are hereby required to furnish to the Oity of
Anaheim in oompanies satisfactory to the City of Anaheim publio
liability, property damage, compensation, and other insuranoe in
the amounts and for the purposes as set forth and 'specified in the
notice inviting sealed proposals and subject to the apprOval of the
City Attorney as to form and sufficiency.
AND ,BE IT FURTHER RESOLVED that the Mayor and the City Olerk
of the City of Anaheim be, and they are hereby, authorized and directed
to make, exeoute and enter into for and ,on behalf of the City of Ana-
n.1m 8 written contract with said successful bidder or bidders for the
furnishing of &ll plant, labor, materials, and equipment and performing
all work as hereinabove more particularly described for the construc-
tion, installation and completion of said public improvement herein-
above described upon the terms and conditions as specified in the
notice inviting sealed propOsals, the detailed design, plans, profiles,
drawings and general specifications and detailed specifications and
draw1ngs and all addenda thereto and all modifications incorporated
therein prior to the date of the opening of bids, on file in the office
of the City Olerk of the City of Anaheim and in strict accordanoe with
the terms, conditions and provisions of this Resolution, and in accord-
ance with all the contract documents herein specified.
