RESOLUTION NO. 3777 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING THE OFFER OF SULLY-MILLER CON- TRACTING COMPANY TO FURNISH .l\LL PLANT, LABOR, SERVICES, MATERIALS AND EQUIllMENT, AND ALL UTILI- TIES AND TRANSPORTATION, INC~UDING POWER, FUEL AND WATER, AND TO PERFORM ALL WORK NECESSARY FOR THE GRADING AND PAVING OF THE CIn YARD ON SOUTH CLAU- DINA STREET, JOB NO. 402; AND AUTHORIZTIiG THE EXECUTION OF AN AGREEMENT TO BE MADE AND ENTERED INTO WITH SAID SULLY-MILLER CONTRAC'l'ING COMPANY. WHEREAS, the City Council dO$s find and determine that puolic convenience and necessity require the grading and paving of the City Yard at $16 South Claudina Street, in the City of Anaheim, Job No. 402; and WHEREAS, Sully-Miller Contracting Company, P. O. Box 432, Orange, California, has offered to furnish all plant, labor, services, materials and equipment, and all utilities and trans- portation, including power, fuel and water, and to perform all work necessary to pave said City Yard at $16 South Claudina Street, Anaheim, Job No. 402, in strict accordance with the specifications plans and drawings therefor on file in the office of the Director of Publio Works of the City of Anaheim, for the sum of $4,893.68, subject to any additions thereto or deductions therefrom which may be made in accordance with the oontract documents; and WHEREAS, the City Council finds that said price is the lowest obtainable for the paving of said City Yard in accordance with the specifications hereinabove referred to, and that the offer of Sully-Miller Contracting Company should be acoepted upon the conditions hereinafter set forth. ,r- NOW, 'fHEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the offer of Sully-Miller Contracting Com- pamy, P. O. Box 432, Orange, California, to furnish all plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and to perfora all work necessary to pave the City Yard at $16 South Claudina Street, in the City of Anaheim, Job No. 402, in accordance with the specifications, plans and drawings therefor on file in the office of the Director of Public Works of the City of Anaheim, be, and the same is hereby, acoepted, upon the following conditions: 1. That Sully-Miller Contracting Company shall com- mence the work hereinabove mentioned immediately following the execution of a contract to be made and entered into by and between said Sully-Miller Contracting Company and the City of Anaheim, and shall continue in a due and diligent workmanlike manner, without interruption, until said job 1s completed. 2. That in the furnishing of all plant, labor, Ser- vioes, materials and equipment, and all utilities and transportation, and the performance of said work, it shall be expressly understood and agreed that Sully-Miller Contracting Company is acting as an independant contractor and not as an agent, servant or employee of the City of Anaheim. -1- ,......... - ".-. AND BE IT FURTHER RESOLVED that the purchase price for the furnishing of all plant, labor, services, materials and equipment and all utilities and transportation, and the perfor- mance of all work necessary for the paving of said City Yard, Job No. 402, shall be paid to the said Sully-Miller Contracting Company as follows: 85% thereat upon the completion and aooeptance of said work, and the remaining'15% thereof thirty (30) days after the filing of notioe of completion of said Job No. 402 by the City. BE IT FURTHER RESOLVED that said Sully-Miller Contract- ing Company shall carry public liability and property damage in- surance in aD amount not less than $100,000.00 for injuries inoluding aocidental death, for anyone person, and subject to the saae limit for each person in an amount not less than $300,000.00 on account of anyone accident, and property damage insurance in an amount not less than $$0,000.00; and shall take out and main- tain during the life of said contract workmen's compensation insur- ance covering all of its employees on the project; and public lia- bility and property damage insurance to cover vehicles used or maintained by it in the performance of said work connected with said improvement, with liability limits of not less than $50,000.00 for anyone person and $100,000.00 for anyone accident, and pro- p~rty damage of $10,000.00. That said Sully-Miller Contracting Company shall also fur- nish a faithful performanoe bond and a labor and material bond for 100% o! the oost of said public improvement. AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk be, and they are hereby, authorized to enter into a oontract with said Sully-Miller Contracting Company, in the usual form approved by the City Attorney, upon the terms and conditions herein specified, and the terms contained in the standard form of contract of the City of Anaheim for public improvements. THE FOREGOING RESOLUTION is signed and approved by me this 2nd day of April, 1957. '!)
