57R-3726 - ,-. RESOLUTION NO. 3726. .~. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANOE NO. 681. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition from the property owners and/or agent of certain real property situ~ted in the City of Anaheim, County of Orange, State of California, described as follows: All that certain land situated in the County of Orange, State of California, described as follows: That portion of Lot 16 of Anaheim Extension, as per map by Wm. Hamel on file in the Recorder's Office of Los Angeles county, California, a copy of which is recorded on Pages 163., et seq.~ in Book 3, entitled "Los Angeles County Maps," in the Office of the County Recorder of Orange County, described as follows: Beginning at a point on the center line of Placentia Avenue, distant thereon South 00 05' 15" West 493.97 feet from the Northeast corner of said Lot 16, said corner being considered to be the intersection of the center lines of South street and Placentia Avenue; thence South 740 36' 05" West 238.23 feet parallel with said center line of South Street to the East line of the land described in deed to C. L. Becker, recorded in Book 161, Page 89 of Deeds of said Orange County; thence South 150 45' 25" East along said East line of said Becker land to the Southwesterly corner of the land described in deed to Jennie B. Matouk, recorded June 3, 1943 in Book 1196, page 47 of Official Records of said Orange County; thence North 740 301 East 185.4 feet along the Southerly line of said Matouk land, to said center line of Placentia Avenue; thence North 00 05' 15" East 208.23 feet to the point of be- ginning. (Said property is located on the west side of Placentia Avenue between South Street and Vermont Avenue.) AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on January 7, 1957, notices of which said public hearing were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and ,- WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 132 -- Series 1956-Y, recommending that Variance No. 681 be denied; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim pro- testing the action of the City Planning Commission denying -1- . '" -- .-. ,"'" said variance, and said appeal was set for public hearing on the 12th day of March, 1957, at 7:00 olclock P.M., in the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find that: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zone. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission denying Variance No. 681, requesting permission to establ ish and operate a retai 1 nu;rsery business on the propertyh~reinabove described, be, and the same is hereby, sustained, and that VARIANCE NO. 681 be, and the same is hereby, denied.
