liHEREAS, the City Council of the Citty of Anaheim did
cause to be published in a newspaper of gen~ral circulation,
9rinted, published and circulated 1n the City of Anaheim, to wit:

furnishing t e following:
All plant, labor, services, material, and equipment, and
all utilities and transportation, in~luding power, fuel
and water, and pertorming all work n~..s.ary to construct
and complete in a good and wGrkaanli~e manner, in strict
accordance with the specifications, plans and drawings
therefor on file in the office of th~ City Clerk of the
City of Anaheim, the following publi~ improvement, to wit:
The East Water Street Sewer Improvem,nt, consisting of the
construction of a la-inch V.C.P. sew,r lateral in Water
Street, from Atchison Street to Oliv. Street, including
trenching, manhole construction, backfill, resurfacing,
Jacking a steel easing, and appurt.n~nt work, as indicated
on the plans, Job No, 1091,
in accordance with the designs, plans, profiles and specifications
of saiCi public improvement on file in the Offj ;e of the C1 ty Clerk
of the City of Anaheim; and
~iHERLAS, said notice inviting sealed.roposals for said
)J.blic improvement did provide that sealed, pro osals vlOuld be re-
calved by the City Council of the City of Anah im at the Office of
the City Clerk of the City of Anaheim up to the hour of 7:00 o'clock
?~.. on the ]..?tA day of __"~c)l , 195,-_for the furnishing
of all plant, labor, services, materials and equipment, all utili-
ties and transportation, inclu6.ing power, fuel and lUl.ter, and per-
forming all work necessary to construct and complete, in a good and
'.'orkmanlike manner, the public improvement hereinabove more particu-
larly mentioned and described and which notice did state and declare
th~t )ursuant to the provisions of Section 1770 of the Labor Code,
the City Council of the City of Anaheim had ascertained the prevailing
rate of vrages in the locality in which this type of labor is to be pe1-
formed. for each craft or ty~)e of "\1Orkman or mechanic needed to execute
the contract and did set forth the prevailing hourly ~~ge scale so
ascertained; and

WHEREAS, the Oity Counoil did thereupon reter said bids to

WHEREAS, the Oity Oounoil tinds that the sealed proposal sub-

i. the lowest responsible proposal submitted tor the furnishing of all
plant, labor, servioes, materials and equipment. all utilities and
transportation. inoluding power, fuel and water and performing all work
neoessary to oonstruot and complete in a good and workmanlike manner
in striot acoordance with the specifications, plans and drawings
therefor on tile in the office of the City Olerk of the Oity of Ana-
helm ot the publiC improvement hereinabove mentioned and desoribed,
together with the appurtenanoes thereto, and as speoified in the
notioe inviting sealed proposals, and that said proposal of said
above named bidder should be accepted and a contraot awarded to said
bidder in acoordanoe therewith; and
WHEREAS, the Oity Council finds that the above mentioned
sealed proposal is the lowest responsible proposal received and that
the person, firm or corporation submitting said proposal is a
responsible person. firm or corporation and that the proposal sub-
mitted is the best suited and fitted for the public improvement to
be oonstruoted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
OITY OF ANAHEIH, that the sealed proposal submitted by
E. E. BERNARD

for the furnishing of all plant, labor. services, materials and
equipment, all utilities and transportation, including power. fuel
and water and performing all work necessary to oonstruot and oomplete
in a good and workmanlike manner, in strict aocordanoe with the
speoifications, plans, and drawings therefor on file in the oftioe
ot the City Olerk of the City of Anaheim and the notioe inviting
sealed proposals, the pUblio works and improvements hereinabove more
partioularly mentioned and described, together with the appurtenanoes
thereto, be, and the same is hereby, accepted, and that a contraot
for the oonstruotion and completion of said public improvement be,
and the same is hereby, awarded to the said above named bidder.
AND BE IT FURTHER RESOLVED that the suooesstul bidder or
bidders upon each contract awarded as hereinabove set forth shall
be, and they are hereby required to execute a contract in the required

form with the City of Anaheim upon the terms and oonditions speoified
in the notioe inviting sealed proposals and the proposal submitted
by said successful bidder or bidders and in accordance with the plans
and specifications for said public improvement hereinabove described
and in accordance with the terms, conditions and prOVisions of this
resolution, and that said successful bidder or bidders to whom each
contract is awarded shall be required to furnish a surety bond in an
amount equal to one hundred per cent (100%) .of the contract price for
all labor, materials and equipment to be furnished and performed as
set forth in the sealed proposals submitted by said bidder for the
construction of said pUblic improvement together with the appurtenances
thereto or such portion thereof as is covered by said contract as
security for the faithful performanoe of said contraot and a separate
surety bond in an amount equal to one hundred per cent (100%) of the
construc~lon cost of said public improvement covered by said oontract
as security for the payment of all persons performing labor and furn-
ishing material for said project.
AND BE IT FURTHER RESOLVED that said successful bidder or
bidders be, and they are hereby required to furnish to the Oity of
Anaheim in companies satisfactory to the Oity of Anaheim public
liability, property damage, compensation, and other insuranoe in
the amounts and for the purposes as set forth and specified in the
notice inviting sealed proposals and subject to the approval of the
Oity Attorney as to form and suffiCiency. .
AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk
of the City of Anaheim be, and they are hereby, authorized and direoted
to make, exeoute and enter into for and on behalf of the City of Ana-
heim 8. written oontract with said successful bidder or bidders for the
furnishing of all plant, labor, materials, and equipment and performing
all work as hereinabove more particularly desoribed for the oonstruo-
tion, installation and completion of said public improvement herein-
above desoribed upon the terms and oonditions as specified in the
notice inviting sealed proposals, the detailed design, plans, profiles,
drawings and general specifications and detailed specifications and
drawings and all addenda thereto and all modifications incorporated
therein prior to the date of the opening of bids, on file in the offioe
of the Oity 01erk of the City of Anaheim and in strict accordance with
the terms, conditions and provisions of this Resolution, and in accord-
ance with all the contract documents herein specified.
