3362ORDINANCE NO. 3362 AN ORDINANCE OF THE CITY OF ANAgEIH AMEND- ING TITLE 18 OF THE ANAHEIM MU14ICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 6 'R-84 gnd 651-287 determining that a change or changes in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Lot 97 of Tract No. 1565, as shown on a map thereof recorded in book 49 , .pages 20 to 24 inclusive, Miscellaneous Maps, records of said Orange'County. EXCEPT all oil, gas and other hydrocarbon substances below the depth of 500 feet from the surface, without the right of entry upon the surface of said land, as conveyed to Fred C. Piepenbrink and Edith 0. Piepenbrink,,. husband and wife, as joint tenants., as disclosed by deeds recorded April 21,.1943,.in book 2490, .page 318 Official Records, in the office of the County Reorder of said Orange. County, and June 3,.1953, in book 2514, page 67, Official Records, in the office of the County Recorder of said Orange County. -1- ATTY-28 6.2-6.3-29 (1) now is R -A, RESIDENTIAL -AGRICULTURAL ZONE and R-1, ONE -FAMILY RESIDENTIAL ZONE, and that .it be'changed to and incorporated in C-1, NEIGHBORHOOD -COMMERCIAL ZONE, subject -to the following conditions: 1.- That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sanitation Division of the Public Works'Department, which areas shall be enclosed with a solid fence'or wall prior to -final building inspection of any proposed alteration of existing residences and/or any new construction. 2. That outdoor storage of any materials shall be prohibited unless- contained within an enclosed trash storage' area. 3. Following removal of the required restrictions on Lots Nos. 96, .97, 98, 100, 10.1 and 102, ,and prior to final building inspection of any new. construction thereon,.provision shall be made for concrete paving and the installation of 5 x 5- ft.- tree wells, spaced at 40 -foot intervals in the parkway portion of the State College'Boulevard and Broadway rights of way -abutting subject lots,.said landscaping to -be subject to the approval of the Superintendent -of Parkway Maintenance. A land- scaped strip of a minimum width .of 3 feet shall also be provided parallel to the State'Colle-ge Boulevard and Broadway rights -of way abutting said lots, which strip shall be landscaped and said landscaping approved prior to -final building inspection of any new construction.on said lots.. 'SECTION 2. The City Zoning Map shall be, .and the same is hereby amended,.and the property above described shall -be excluded from the zone in which it is now situated, and.incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and fine City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. 'SECTION 3. The City Clerk shall certify to the .passage of this ordinance and shall cause the same -to be printed once within fifteen.' (15) days after its -adoption, .in the Anaheim Bulletin, . a newspaper of general circulation, printed, published and cir- culated in. -said City, and thirty (30) days from and after its - final passage it shall take effect -and be in full force. .
