3340ORDINANCE NO.' ' ' ' 3340 AN ORDINANCE OF THE CITY OF ANAHEIM REPEALING TITLE 15-, CHAPTER 15.50.0F THE ANAHEIM MUNICIPAL CODE AND ADOPTING THE 1973 EDITION OF THE INTER- NATIONAL CONFERENCE OF BUILDING OFFICIALS, UNIFORM MECHANICAL CODE, WITH AMENDMENTS THERETO, AND AMENDING TITLE 15, BY ADDING THERETO A NEW CHAPTER 15.50.. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: 'SECTION 1. That Title 15, Chapter 15.50 of the Anaheim Municipal Code be, and the same '.is hereby. repealed. .SECTION 2. That :Title .15 of the Anaheim Municipal Code be, and the same .is hereby amended by adding thereto a new Chapter 15.50 to read as follows: "CHAPTER 15.50 MECHANICAL CODE Section 15.50.00.1 APPROVAL OF CODE The City Council does hereby find and determine,. as -the result of investigation and tests. -conducted by theCity and its Building Official, that the Uniform mechanical -Code, 1973''Edition, of the' International Conference .of Building Officials -and the International Conference of Plumbing and Mechanical Officials is an approved Code for adoption by reference within the meaning of Section 50022.1 -of the Government Code'of the State of California. Section 15.50..010-. ADOPTION OF CODE Pursuant to the provisions -of Sections 50022..1 to 50022.8, both .inclusive,. of the Government Code .of the 'State-,' the City of Anaheim does hereby adopt by reference the Uniform Mechanical Code, ,1973 Edition, with amendments thereto, .and the Appendices; three copies -of said Code shall be filed in the office of the City Clerk of the City of Anaheim at .least fifteen days preceding the hearing, hereinafter provided for and shall be kept therefor public inspection while said Code 'is in force; all -of which copies shall be certified to betrue copies by the City Clerk; following the adoption of said Code,'.the City Clerk shall -at all times maintain a reasonable supply of copies of said code Avail- able for purchase by the public. Section 15.50.202 VIOLATIONS.AND PENALTIES Section 202 of the'Uniform Mechanical Code is hereby amended to- read as follows Section 202.. The penalty for violation of any provisions of this Code shall be as specified in Section 1'.01.370.of the Anaheim Municipal Code.. -1- Section 15.50.20.3' BOARD OF APPEALS Section 203 of the Uniform Mechanical Code'is hereby amended to read as -follows: - Section 203. In order to determine the suitability. of alternate materials -and methods -of construction and to provide for reasonable interpretations of the provisions of this Code, there .shall be and is hereby created a Board -of Appeals.- The Building Official shall be an ex officio member and shall act as -Secretary of the Board. The Board of Appeals may be the City -Council.- The Board shall adopt reasonable -rules and reOulations-for conducting its- investigations -and shall render all decisions and findings in writing to the'Building Official with a duplicate'.copy to the appellant and may adopt such new legislation as -is consistent therewith.' Section 15.50.304 PERMIT FEES Section 304 of the Uniform Mechanical Code is hereby amended to read as follows: Section 304. Every applicant for a permit to do work regulated by this -code shall -state in writing on the application form provided for that,purpose,'.the character of work proposed to be done and the amount .and kind in connection therewith,. together with .such information, ,pertinent thereto, .as may be required.. The fees which shall be paid to:the Building Official as - the cost of permit shall be as determined and set -forth by resolution of the City Council. Section 15.50.511. Chapter 5 of the Uniform Mechanical Code is hereby amended by adding thereto Section 15.50.511. Section 15.50.511 PROHIBITED LOCATIONS Section 511. Equipment regulated by this Code shall not be located in any required front or side yard asestablished by the zoning ordinances. Section 15.50.512 Chapter 5 of the Uniform Mechanical Code is hereby amended by adding thereto -Section 15.50.512. Section 15.50.512- SCREENING Section 5120' Equipment regulated by -this Code, when located on the roof or outside of the building, shall be screened from public view. Such screening shall conform to the architecture of the building. EXCEPTION: Window air conditioners Section 15.50.513 Chapter 5 of the Uniform Mechanical Code is hereby amended by adding thereto Section 15.50.513. Section 15.50.513 NOISE ABATEMENT Section 513. Equipment regulated installed so that :it will not produce' limits --set forth 'in Section 16.70..010 Code.. -2- by this Code shall be a sound level above the of the Anaheim Municipal Section 15.50.1109 HOODS Paragraph (b.) of Section 1109 of the Uniform Mechanical Code is hereby amended by adding thereto the -following item 9. . 9. Every commercialgrease hood shall be equipped with an approved automatic -fire e*tinguishing.system. Section 15.50..1202.. INSTALLATION Section 1202 of the Uniform Mechanical Code is hereby amended -by adding thereto. the following paragraphs Air cooled condensers or cooling towers located within a building or confined space .shall have the air discharge directly to the outside of the building. Section 15.50.1901 RANGES Section 1901 of the Uniform Mechanical Code is hereby amended by adding thereto the following paragraph '.(C') . (c.) RESIDENTIAL KITCHEN VENTILATION.. Domestic freestand- ing or built-in ranges shall have'an.approved type 'of mechanical exhaust installed directly above .the range. Section 15.50..2100. STEAM AND HOT WATER BOILERS Chapter 21 of the Appendix of the Uniform Mechanical Code is hereby amended by deleting therefrom Section 2124,.Section 2125,.and Section 2126. 'SECTION 3. SEVERABILITY. The City Council of the'City of Anaheim hereby declared that should any section,.paragraph,.,sentence or word of this chapter of the Code hereby adopted be declared for any reason to be invalid, .it is the intent -of the Council that it would have passed all other portions -of this chapter. indepen- derit -of the elimination herefrom of any such portion as may be declared invalid. SECTION 4. The City Clerk shall -certify to the passage of this ordinance and shall cause the same'to be printed once -within fifteen (.15) days after its adoption, in the Anaheim Bulletin,. a newspaper of general circulation,.printed, ,published and cir- culated in said City, -.and thirty.
