3332ORDINANCE NO. 3332 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 73R-248 & 74R-209 determining that a change or changes the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: That portion of the Rancho Santiago de Santa Ana as shown on a map filed in book 13, page 45 of Record of Surveys, records of said Orange County, being also portions of the land described in deed to Dorothy C. Pardo, recorded March 26, 1971 in book 9584, page 817, Official Records of said Orange County, described as follows: Commencing at the most Easterly corner of the land described in said Deed, said point being South 55° 12' 00" West along the Southeasterly line of said Survey -387.10 feet from the most Easterly corner thereof; thence North 37° 21' 00" West along the Northeasterly line of said Deeds, 305.27 feet and North 45° 191 00" West 19.22 feet; thence leaving said Northeasterly line South 59° 00' 33" West 113.54 feet; thence North 45° 19' 00" West 53.47 feet to the true point of beginning of the boundary of the land herein described; thence continuing North 45° 19' 00" West 120.53 feet; thence North 3V 53' 34" West 95.00 feet to the Northwesterly line of said deed; thence along the Northwesterly and Southwesterly 72-73-51(10) -1- lines of said deed South 68° 55' 00" West 119.33 feet and South 45° 19' 00" East 225.00 feet to a point which bears South 55° 26' 37" West from the true point of beginning; thence North 55° 26' 37" East 91.61 feet to the true point of beginning. EXCEPTING THEREFROM that portion included within Mohler Place. now is R -A, AGRICULTURAL ZONE, and that it be changed to and incorporated in RH-22,000 RESIDENTIAL HILLSIDE LOW DENSITY SINGLE FAMILY ZONE, subject to the following conditions: 1. That all engineering requirements of the City of Anaheim such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer, at the time the property is developed. 2. That the owner(s) of subject property shall install street lighting on all streets within the area as required by the Director of Public Utilities at the time the property is developed. 3. That electrical utilities shall be placed under- ground and dedicated to the City of Anaheim in accordance with the requirements of the Director of Public Utilities. 4. That drainage of said property shall be disposed of in a manner satisfactory to the City Engineer. If, in the preparation of the site, sufficient grading is required to necessitate a grading permit, no work on grading will be permitted between October 15th and April 15th unless all required off-site drainage facilities have been installed and are operative. Positive assurance shall be provided the City that such drainage facilities will be completed prior to October 15th. Necessary right-of-way for off-site drain- age facilities shall be dedicated to the City, or the City Council shall have initiated condemnation proceedings there- for (the cost of which shall be borne by the developer) prior to commencement of grading operations. The required drainage facilities shall be of a size and type sufficient to carry runoff waters originating from higher properties through said property to ultimate disposal as approved by the City Engineer. Said drainage facilities shall be the first item of construction and shall be completed and be functional throughout the tract and from the downstream boundary of the property to the ultimate point of disposal prior to the issuance of any final building inspections or occupancy permits. Drainage district reimbursement agree- ments may be made available to the developers of said property upon their request. -2- SECTION 2. The City Zoning Map shall be, and the same is r—. hereby amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby dpprov'ed`and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
