3314ORDINANCE NO. 3314 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 739::24A an 74R-209 determining that a change or changes in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a -sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: That .portion of Section 6, Township 4 South, Range 8 West, San Bernardino Base and Meridian, in the County of Orange, State of California, described as follows: Beginning at a point on the southerly boundary of the land described in Parcel 1 of the deed to Wesley A. Harting and wife, recorded March 6, 1962, in Book 6029, page 334, Official Records, said point also being on a curve in the northerly boundary of the land described in Parcel 1 of the deed to Jacob G. Timken and wife, recorded February 28, 1948 in Book 1730, page 326, Official Records, said curve being concave southerly, having a radius of 700 feet and'a length of 200.26 feet, said point of beginning being distant thereon 90.98 feet easterly from the westerly terminus of said curve; running thence easterly along said curve through a central angle of 80 56' 41" an arc distance of 109.28 feet to a tangent line in said northerly boundary of the land of Timken; thence South 830 13' 00" East along said tangent line, 5.66 feet; thence North 60 47' 00" East 194.39 feet to a point which bears South 830 49' 42" West 74 feet from a point in the easterly boundary of said land of Harting which is distant thereon North 250 30' 00" -1- 72-73-51(6) West 245 feet -from the southeasterly corner of said land; thence South 83" 491 42" West 145 feet; thence South 29'09' 411' East 172,29 feet to the point of beginning. now is R-Af AGRICULTURAL ZONE, and that it be changed to and incorporated in RH-2200.0, RESIDENTIAL HILLSIDE LOW DENSITY SINGLE PAMILY ZONE, subject to the following conditions: 1,- That all engineering requirements of the City of Anaheim such as curbs and gutters,.sidewalks, street grading and paving, drainage .facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accor- dance with standard plans and specifications on file in the office of the City Engineer, at the time the property is developed. 2, That the owner (s.)- of subject property shall install street lighting on all streets within the area as required by the Director of Public Utilities at the time the property is developed, 3: That electrical utilities shall. be placed under- ground and dedicated to the City of Anaheim in accordance with the requirements of the Director of Public Utilities, 4, That drainage of said property shall be disposed of in a manner satisfactory to the City Engineer, If, in the preparation of the site, sufficient grading is required to necessitate a grading permitf no work on grading will be per- mitted between October 15th and April 15th unless all required off-site drainage facilities have been installed and are opera- tive,i Positive assurance shall beprovided the City that such drainage facilities will be completed prior to October 15th. Necessary right -,of -Tway for offsite drainage .facilities shall be dedicated to the City or the City Council shall have initi- ated condemnation proceedings therefor (.the.cost of which shall be borne by the developer) prior to commencement of grading operations, The required drainage facilities shall be of a size and type sufficient to carry runoff waters originating from higher properties through said property to ultimate dis- posal as approved by the City Engineer. Said drainage facili- ties shall bethe first item of construction and shall be completed and be functional throughout the tract and from the downstream boundary of the property to the ultimate point of disposal prior to the Issuance of any final building inspections or occupancy permits, Drainage district reimbursement agree menta may be made available to the developers of said property upon their request, SECTION 2, The City Zoning Map shall be' and the same is hereby amended, and the property above descriLed shall be excluded from the zone in which it is now .situated, and incorporated in and made a part of the zone or zones as above set forth and said City Zoning Map as amended is hereby adopted and ild City Engineer is hereby directed to prepare'a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. -2- SECTION 3. The City. Clerk shall ceitify to-the'passage of'this Ordinance:and-shall-cause-the'same to-be:orinted'once'within fifteen (15). days- after' its- adoption; in the' Anaheim Bulletin, a newspaper'of'general circulation', printed, published and circulated' in said City; - and thirty-.
