4264ORDINANCE NO. 4264 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING SUBSECTIONS .101 AND .102 OF SECTION 18.04.043 OF CHAPTER 18.04, SUBSECTION .0262 OF SECTION 18.31.063 AND SUBSECTION .021 OF SECTION 18.31.068 OF CHAPTER 18.31, SUBSECTION .0272 OF SECTION 18.32.063 AND SUBSECTION .021 OF SECTION 18.32.068 OF CHAPTER 18.32, SUBSECTION .0272 OF SECTION 18.34.063 AND SUBSECTION .021 OF SECTION 18.34.068 OF CHAPTER 18.34, AND REPEALING SUBSECTION .0263 OF SECTION 18.31.063 OF CHAPTER 18.31, SUBSECTION .0273 OF SECTION 18.32.063 OF CHAPTER 18.32 AND SUBSECTION .0273 OF SECTION 18.34.063 OF CHAPTER 18.34, TITLE 18, OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Subsections .101 and .102 of Section 18.04.043 of Chapter 18.04 of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: 11.101 Fences, Walls and Hedges in Front Yards. Except as otherwise provided herein, the maximum height of any fence, wall or hedge shall not exceed forty-two (42) inches within any required front setback area, excepting residential lots front- ing onto any arterial street, as designated on the General Plan, in which case walls or fences not to exceed eight (8) feet in height, and/or screen type planting of any height, shall be permitted as a means of preserving a residential environment. Wrought iron or other types of decorative open-work metal fences, excluding chain link, shall be permitted to a maximum height of six (6) feet, provided that (1) the component solid portions of said fence do not consti- tute more than twenty (20) percent of the total sur- face of its face and (2) the Planning Department �.. reviews and approves said .fence as not obstructing any vehicular line -of -sight. -1- .102 Fences, Walls and Hedges in Rear and Side Yards. Fences, walls or hedges not to exceed six (6) feet in height shall be permitted in any required rear or side yard; provided, however, that within the required street side setback of any reversed corner lot or reversed building frontage on a normal corner lot, the provisions of Section 18.04.043.101 shall apply. Notwithstanding the-`oregoing, a chain link fence not exceeding ten (10) feet in height shall be permitted in any required rear or side yard, except the street side of any reversed corner lot, provided said fence is used as part of the enclosure of a tennis or paddle ball court." SECTION 2. That Subsection .0262 of Section 18.31.063 and Subsection .021 of Section 18.31.068 of Chapter 18.31, Subsection .0272 of Section 18.32.063 and Subsection .021 of Section 18.32. 068 of Chapter 18.32, and Subsection .0272 of Section 18.34.063 and Subsection .021 of Section 18.34.068 of Chapter 18.34 0£ Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: "Fences, walls and hedges conforming to the provisions of Section 18.04.043 of this Code." SECTION 3. That Subsection .0263 of Section 18.31.063 of Chapter 18.31, Subsection .0273 of Section 18.32.063 of Chapter 18.32, and Subsection .0273 of Section 18.34.063 of Chapter 18.34 be, and the same are hereby, repealed. SECTION 4. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal hereby of any other ordinance of the City shall in any manner affect the prosecution for violations of ordinances, which villa - tions were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal pro- visions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments. -2- SECTION 5. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this chap- ter of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this chapter independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 6. The City Clerk shall certify to the passage of this or- dinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
