AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
TITLE 10, CHAPTER 10.10 OF THE ANAHEIM MUNI-
CIPAL CODE BY AMENDING SECTION 10.10.120
THEREOF PERTAINING TO ENFORCEMENT PROVISIONS
AND ADDING SECTION 10.10.115 PERTAINING TO
FAILURE TO CORRECT VIOLATION.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
SECTION 1.
That Title 10, Chapter 10.10, Section 10.10.120 is
hereby amended to read as follows:
"10.10.120 ENFORCEMENT PROVISIONS.
.010 In addition to other persons authorized
by law, all Sanitation Inspectors shall have the duty of enforcing
the provisions of this Chapter.
In connection with such enforcement,
they are authorized, upon probable cause, and in accordance with
applicable State and Federal law to enter and inspect, at any
reasonable time, any premises for the purpose of investigating
suspected or reported violations of this Chapter. They may also
approach any person apparently the owner, tenant, lessee, or
person in control of the premises to verify compliance with the
provisions of this Chapter. Such persons are hereby authorized
to issue citations to persons violating any of the provisions of
this Chapter to appear in the Court of the North Orange County
Judicial District at a time fixed in the citation, not less than
five (5) days from the date of issuance of the citation unless a
shorter period of time is requested by the person(s) to whom the
citation is issued, and such citation shall be deemed to be a
complaint charging violations of this Chapter.
.020 Violation of any of the provisions of
this Chapter is hereby declared to be an infraction."
SECTION 2.
That Title 10, Chapter 10.10 of the Anaheim Municipal
Code be, and the same is hereby amended by adding Section
10.10.115 to read as follows:
"10.10.115 FAILURE TO CORRECT AFTER NOTIFICATION.
Any person who is the owner, tenant, lessee,
or person in control of premises in the City of Anaheim, and who,
after written notice of a violation from the City of Anaheim,
wilfully fails or refuses.to correct such violation of this
Chapter within the time specified on such written notice shall
be guilty of an infraction."
