4268ORDINANCE NO. 4268 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING ORDINANCE NO. 4087 PERTAINING TO CABLE COMMUNICATION SERVICES IN THE CITY OF ANAHEIM. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That SECTION 30, entitled "CONSTRUCTION" of Ordinance No. 4087 be, and the same is hereby repealed. SECTION 2. That a new SECTION 30 entitled "CONSTRUCTION" is hereby enacted by the City Council to read as follows: SECTION 30. CONSTRUCTION Grantee does agree as stated in its proposal to commence construction of its Cable Communication System within thirty (30) days of the date of Ordinance No. 4087, and will diligently proceed with all construc- tion thereunder so as to cause Phase 1 to be completed within fifteen (15) months from the date of execution of Ordinance No. 4087; and Phase 2 shall be completed within twenty-five (25) months from the date of execution of Ordinance No. 4087; and Phase 3 within thirty-six (36) months of the date of execution of Ordinance No. 4087. RRC'TTnN I _ That a new SECTION 37 entitled "PROPOSED SERVICES" is hereby enacted by the City Council to read as follows: SECTION 37. PROPOSED SERVICES Proposed channel configuration to be furnished -- subscribers of the Cable Communication System shall be as approved by the City Council by resolution from time to time. -1- SECTION 4. LENGTH OF FRANCHISE For and in consideration of the sum of $100,000.00 paid by grantee to grantor on the effective date of this ordinance all prior penalties imposed for any failure of grantee pursuant to Ordinance No. 4087, are hereby waived and the length of the franchise shall be fifteen (15) years from the effective date of Ordinance No. 4087. SECTION 5. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this chapter of the Code hereby adopted be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this chapter independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 6. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal hereby of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were com- mitted prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments. SECTION 7.
