4287FOLLOWS: ORDINANCE NO. 4287 AN ORDINANCE OF THE CITY OF ANAHEIM ADDING NEW CHAPTER 18.35 TO TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That new Chapter 18.35 be, and the same is hereby, added to Title 18 of the Anaheim Municipal Code to read as follows: "Chapter 18.35 'RM -1000' RESIDENTIAL, MULTIPLE -FAMILY ZONE SECTION 18.35.010 DESCRIPTION AND PURPOSE. This zone is intended to provide for and encourage the orderly development of areas appro- priate for medium density residential land uses and to en- courage the development of residential projects comprising a wide variety of dwelling types integrated with substan- tial open space areas and other amenities which harmonize with existing and proposed land uses in the vicinity. SECTION 18.35.020 PERMITTED PRIMARY USES AND STRUCTURES. Subject to the provisions of this zone, excepting as otherwise provided herein, the following primary buildings, structures and uses, either singly or in combination, are permitted: .010 Detached one -family dwellings, subject to compliance with all requirements of the RS -5000 Zone. .020 Attached or semi -attached one - family dwellings including, but not limited to, condomin- iums, community apartments, stock cooperatives, townhouses, rowhouses or other forms of clustered dwellings, subject to compliance with the provisions for Residential Planned Unit Developments as prescribed in Section 18.31.020.051 of this Code. .030 Two-family dwellings. .040 Multiple -family dwellings. -1- .050 Residential Planned Unit Developments (R.P.U.D.'s) comprised of any or all of the dwelling unit types specified in Subsections .010 through .040 above, in any variety of ownership and structural types, subject to compliance with the provisions of this chapter and the conditions and limitations specified in Section 18.31.020.051 of this Code. SECTION 18.35.030 PERMITTED ACCESSORY USES AND STRUCTURES. Accessory buildings, structures, and uses permitted in this zone shall be the same as those specified in Section 18.31.030 of this Code. SECTION 18.35.040 PERMITTED TEMPORARY USES AND STRUCTURES. Temporary buildings, structures and uses permitted in this zone shall be the same as those specified in Section 18.31.040 of this Code. SECTION 18.35.050 CONDITIONAL USES AND STRUCTURES. The conditional uses and struc- tures permitted in this zone shall be the same as those specified in Section 18.31.050 of this Code and shall be further subject to approval of a conditional use permit in compliance with the conditions and required showings of Section 18.03.030 'Conditional Use Permits - General." The site development standards of this chapter shall apply except as otherwise specifically approved by vari- ance or waiver, or otherwise required in conjunction with said permit. SECTION 18.35.060 SITE DEVELOPMENT STANDARDS. For detached one -family dwell- ings, the provisions of Chapter 18.27 'RS -5000' Zone shall apply. For attached or semi -attached one -family dwellings, two-family or multiple -family dwellings, except as hereinafter provided in this chapter, the stand- ards and provisions of Chapter 18.04 'Site Development Standards - General' and Chapter 18.31 'RM -3000' Residential Multiple -family Zone Sections 18.31.062 through 18.31.069 shall apply in order to assure adequate levels of light, air and density of development, to main- tain and enhance locally recognized values of community appearance, and to promote the safe and efficient circu- lation of pedestrian and vehicular traffic. These standards are found to be necessary for the preservation of the community health, safety and general welfare. -2- SECTION 18.35.061 BUILDING SITE REQUIREMENTS. The area and dimensions of all building sites shall be sufficient to accommodate the anticipated number of dwelling units, parking spaces, open areas and other structures and uses for which pro- visions are made in this zone. Provided, further, that the width of any project building site shall be not less than seventy (70) feet, excepting that a building permit may be approved for development on any City - approved, existing lot of record having a lesser width than herein specified subject to compliance with all other provisions of this title. .010 Minimum Building Site Area per Dwelling Unit. The minimum net building site area for any attached or semi -attached one -family dwellings, two-family or multiple -family dwelling units shall be one thousand (1000) square feet for each dwelling unit excluding any public streets or alleys. .020 Where there are existing build- ings and structures on a site for which more intensive development is proposed under the provision of this zone, no building permit shall be issued until the Chief Building Inspector and the Fire Chief have certified that the existing buildings and structures are safe for occu- pancy and for human habitation. Further, no dwelling unit originally designed or intended as an apartment unit or other structure shall be sold as a separate living unit, either as a condominium or community apartment, except in compliance with the site development standards of this chapter as verified by the issuance of a Condominium Conversion Permit by the Zoning Division of the Planning Department. SECTION 18.35.100 DEDICATION AND IMPROVEMENTS. Where dedicated streets or public works or utility easements are necessary to assure orderly development of the area, prevent conges- tion or to preserve the public health, safety or general welfare, dedication and/or improvements shall be required prior to final acceptance or any construction on any new lots created by lot split or subdivision. Isla SECTION 18.35.110 DEVELOPMENT REVIEW AND PERMITS. Prior to commencing any work pertaining to the erection, construction, reconstruc- tion, moving, conversion, alteration or addition to any building or structure within this zone, all building and site plans shall be subject to review by the Development Review Committee and permits shall be secured from the Chief Building Inspector of the City of Anaheim. Provided, further, that where there are existing build- ings and structures on a site for which more intensive development is proposed under the provisions of this zone, no building permit shall be issued until the Chief Building Inspector and the Fire Chief have certified that the existing buildings and structures are safe for occu- pancy and for human habitation. SECTION 18.35.120 PENALTIES FOR VIOLATIONS. Any violation of the provisions of this chapter shall be subject to penalties as pre- scribed by this Code. SECTION 18.35.130 AMENDMENTS, CONDITIONAL USE PERMITS AND VARIANCES. Boundaries of the zones estab- listed by this title, the classification of property uses therein, or other provisions of this title may be amended, exceptions made therefrom, or conditional uses permitted in accordance with the facts, conditions, pro- cedures and required showings specified in this Code." SECTION 2. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this chap- ter of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this chapter independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 3. The City Clerk shall certify to the passage of this or- dinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force. am THE FOREGOING ORDINANCE is approved and adopted by the City Council of the City of Anaheim this 8th day of December, 1981.
