66-693WHEREAS, heretofore, by its resolution duly adopted
and passed on the 15th day of September, 1964, the City of
Anaheim authorized and directed the initiation of condemnation
proceedings which resulted in the commencement of Orange County
Superior Court Case No. 129556, being entitled "City of Anaheim
vs. Henry Wagner, et ux., et al. and
WHEREAS, Defendants Henry Wagner and Emma C. Wagner
have offered to deed the property sought to be condemned by
the City of Anaheim to the City for a total cash consideration
of $2800.001(covering two parcels of easements for highway
and public utility purposes); and
WHEREAS, The City Council of the City of Anaheim
finds that the sum of $2800.00 is a fair and reasonable amount
to be paid for the property condemned.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the Director of Finance be, and
he is hereby authorized and directed to deliver to the City
Attorney's Office the sum $2800.00, payable to Henry Wagner
and Emma C. Wagner, to be delivered by the City Attorney to
said defendants, Henry Wagner and Emma C. Wagner, when the
City Attorney holds an easement deed in favor of the City
of Anaheim, executed by Henry Wagner and Emma C. Wagner con-
veying the property condemned.
THE FOREGOING RESOLUTION is approved and signed by
me this 25th day of October, 1966.
