4374ORDINANCE NO. 4374 AN ORDINANCE OF THE CITY OF ANAHEIM RE- PEALING SECTION 6.44.070 OF THE ANAHEIM MUNICIPAL CODE AND ADOPTING A NEW SECTION 6.44.070, IN PLACE THEREOF PERTAINING TO NUISANCES. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 6.44.070 be, and the same is hereby, repealed. SECTION 2. Section 6.44.070 is hereby added to the Anaheim Municipal Code to read as follows: 6.44.070 EFFECT OF FAILURE TO ABATE. If the nuisance is not abated within the period given in the notice, the Council may determine to proceed with the abatement. When it determines to proceed, the Council shall give a second notice in the same manner set forth in Section 6.44.040 and 6.44050. The second notice shall direct the persons to appear before the Council or such other person as the Council specifies in the notice at a stated time and place and show cause why the nuisance should not be abated. The notice shall be headed "NOTICE OF HEARING TO DETERMINE EXISTENCE OF PUBLIC NUISANCE AND TO ABATE IN WHOLE OR PART" in letters of not less than 1" in height and shall be substantially in the following form: NOTICE OF HEARING TO DETERMINE EXISTENCE OF PUBLIC NUISANCE AND TO ABATE IN WHOLE OR PART Notice is hereby given that on the day of , 19 the City Counci1--of—the City of Anaheim passed a resolution declaring its intent to ascertain whether certain premises situated in the City of Anaheim, State of California, known and designated as in said City, and more particularly described as Lot No. , Tract No. constitute a public nuisance subject to abatement by the rehabilitation of buildings or structures situated thereon. If said premises, in whole or part, are found to constitute a public nuisance as defined by Section 6.44.010 of the Anaheim Municipal Code and if the same are not promptly abated by the owner, such nuisances may be abated by municipal authorities, in which case the cost of such rehabilitation, repair, or demo- lition will be assessed upon such premises and such cost will constitute a lien upon such land until paid. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this chapter of the Code hereby adopted be declared for any reason to be invalid, it the intent of the Council that it would have passed all other portions of this chapter independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 4. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal hereby of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as.new enactments. SECTION 5. The City Clerk shall .certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force. -2- the City November ATTEST: THE FOREGOING ORDINANCE is approved and adopted by Council of the City of Anaheim this 9th day of . 1982.
