ORDINANCE NO. 4382
AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
VARIOUS CHAPTERS, SECTIONS, SUBSECTIONS, PARA-
GRAPHS AND SUBPARAGRAPHS OF TITLE 18 OF THE
ANAHEIM MUNICIPAL CODE RELATING TO HEALTH SPAS
AND PHYSICAL FITNESS CENTERS.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
SECTION 1.
That the following provision be, and the same is
hereby, added as new Subsection .045 to Section 18.41.020 of
Chapter 18.41, new Subsection .085 to Section 18.42.020 of
Chapter 18.42, new Subsection .185 to Section 18.44.020 of
Chapter 18.44, new Subsection .195 to Section 18.45.020 of
Chapter 18.45, new Subsection .275 to Section 18.46.020 of
Chapter 18.46, and new Subsection .005 to Section 18.48.020 of
Chapter 18.48, all of Title 18 of the Anaheim Municipal Code, to
read as follows:
"Health Spas and Physical Fitness Centers (if less
than 4,000 square feet in gross floor area)."
SECTION 2.
That the following provision be, and the same is
hereby, added as new Subsection .095 to Section 18.41.050 of
Chapter 18.41, new Subsection .065 to Section 18.42.050 of
Chapter 18.42, new Subsection .155 to Section 18.44.050 of
Chapter 18.44, new Subsection .155 to Section 18.45.050 of
Chapter 18.45, new Subsection .145 to Section 18.46.050 of
Chapter 18.46, and new Subsection .125 to Section 18.48.050 of
Chapter 18.48, all of Title 18 of the Anaheim Municipal Code, to
read as follows:
"Health Spas and Physical Fitness Centers (of 4,000
square feet in gross floor area or larger)."
SECTION 3_
That new Subsections .215 and .606 be, and the same are
hereby, added to Section 18.61.050 of Chapter 18.61 of Title 18
--- of the Anaheim Municipal Code, to read as follows:
"Health Spas and Physical Fitness Centers."
SECTION 4.
That new Subparagraph .02555 be, and the same is
hereby, added to Paragraph .025 of Subsection .020 of Section
18.06.050 of Chapter 18.06 of Title 18 of the Anaheim Municipal
Code, to read as follows:

"Health Spas and Physical Fitness Centers: Five and
one-half (5.5) spaces per 1,000 square feet of gross
floor area for facilities under 4,000 square feet; for
facilities 4,000 square feet or larger, parking require-
ments shall be determined by the Planning Director
and/or City Council based upon a parking demand study
prepared by an independent traffic engineer licensed by
the State of California, or such other study as approved
by the City Traffic Engineer and provided at the devel-
oper's sole expense at the time of application for such
use."
SECTION 5. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal
hereby of any other ordinance of the City shall in any manner
affect the prosecution for violations of ordinances, which
violations were committed prior to the effective date hereof, nor
be construed as a waiver of any license or penalty or the penal
provisions applicable to any violation thereof. The provisions
of this ordinance, insofar as they are substantially the same as
ordinance provisions previously adopted by the City relating to
the same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
SECTION 6. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
chapter of the Code, hereby adopted, be declared for any reason
to be invalid, it is the intent of the Council that it would have
passed all other portions of this chapter independent of the
elimination herefrom of any such portion as may be declared
invalid.
SECTION 7. CERTIFICATION
The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be printed once within fif-
teen (15) days after its adoption in the Anaheim Bulletin, a
newspaper of general circulation, printed, published and circu-
lated in said City, and thirty (30) days from and after its final
passage, it shall take effect and be in full force.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 25th day of January, 1983.
