4384ORDINANCE NO. 4384 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING VARIOUS CHAPTERS, SECTIONS AND SUBSECTIONS �. OF TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO VEHICLE PARKING AND LOADING REQUIREMENTS. FOLLOWS: THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That Section 18.01.030 of Chapter 18.01 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended by deleting the definition of "Bachelor Apartments" therefrom and adding in its place and stead the definition of "Bachelor Unit" to read as follows: "'Bachelor Unit.' One room and bath, with or without cooking facilities, in a multiple dwelling." SECTION 2. That Section 18.01.040 of Chapter 18.01 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended by deleting the definition of "'Carport' or 'Porte-Cochere'" therefrom and adding in its place and stead the definition of "Carport" to read as follows: "'Carport.' A permanently roofed structure with not more than three (3) enclosed sides used, or intended to be used, for automobile shelter and storage." SECTION 3. That Section 18.01.170 of Chapter 18.01 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended by adding thereto the definitions of "Parking Space, Covered" and "Porte-Cochere" to read, respectively, as follows: "'Parking Space, Covered.' A parking space which is covered by a roof supported by poles, columns, walls or other structural elements, including carports and roofed porte-cocheres." "'Porte-Cochere.' An accessory residential use consisting of a reserved space, roofed or unroofed, and attached to the side of a dwelling, and established for the convenient loading and unloading of passengers." -1- SECTION 4. That Subsection .101 of Section 18.04.04.3 of Chapter 18.04 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".101 Fences, Walls and Hedges in Front Yards. Except as otherwise provided herein, the maximum height of any fence, wall or hedge shall not exceed thirty-six (36) inches within any required front setback area, excepting residential lots fronting onto any arterial street, as designated on the General Plan, in which case walls or fences not to exceed eight (8) feet in height, and/or screen type planting of any height, shall be permitted as a means of preserving a residential environment. Wrought iron or other types of decorative open-work metal fences, excluding chain link, shall be permitted to a maximum height of six (6) feet, provided that (1) the component solid portions of said fence do not constitute more than twenty (20) percent of the total surface of its face and ( 2 ) the Planning Department reviews and approves said fence as not obstructing any vehicular line -of -sight." SECTION 5. That Subsection .030 of Section 18.04.043.030 of Chapter 18.04 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".030 Carports or Porte-Cocheres in Required Yards. A carport or porte-cochere may be located and maintained in any required side or rear yard." SECTION 6. That the following provision be, and the same is hereby, added as new Subsection .325 to Section 18.21.050 of Chapter 18.21, new Subsection .075 to Section 18.22.050 of Chapter 18.22, new Subsection .065 to Section 18.23.050 of Chapter 18.23, new Subsection .065 to Section 18.24.050 of Chapter 18.24, new Sub- section .065 to Section 18.25.050 of Chapter 18.25, new Subsection .065 to Section 18.26.050 of Chapter 18.26, new Subsection .100 to Section 18.27.050 of Chapter 18.27, new Subsection .070 to Section 18.31.050 of Chapter 18.31, new Subsection .100 to Section 18.32. 050 of Chapter 18.32, new Subsection .130 to Section 18.34.050 of Chapter 18.34, new Subsection .165 to Section 18.41.050 of Chapter 18.41, new Subsection .140 to Section 18.42.050 of Chapter 18.42 -2- new Subsection .305 to Section 18.44.050 of Chapter 18.44, new Subsection .295 to Section 18.45.050 of Chapter 18.45, new Subsec- tion .275 to Section 18.46.050 of Chapter 18.46, new Subsection .205 to Section 18.48.050 of Chapter 18.48, new Subsection .435 to Section 18.61.050 of Chapter 18.61, new Subsection .375 to Section 18.63.050 of Chapter 18.63, new Subsection .080 to Section 18.81.050 of Chapter 18.81, and new Subsection .080 to Section 18.82.050 of Chapter 18.82, all of Title 18 of the Anaheim Municipal Code, to read as follows: "Senior Citizens' Residential Developments; provided that, notwithstanding any other provision of this Code to the contrary, the site development standards for any such use, other than vehicle parking and loading requirements, shall be as expressly approved for such development pursuant to said conditional use permit." SECTION 7. That Subsection .013 of Section 18.21.063 of Chapter 18.21, Subsection .013 of Section 18.22.063 of Chapter 18.22, Subsection .0133 of Section 18.23.063 of Chapter 18.23, Subsection .0113 of Section 18.24.063 of Chapter 18.24, Subsection .0113 of Section 18.25.063 of Chapter 18.25, Subsection .0113 of Section 18.26.063 of Chapter 18.26, and Subsection .0123 of Section 18.27.063 of Chapter 18.27, all of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: "That, in addition to the minimum two (2) parking spaces required to be provided in such garage, two (2) additional nontandem, open or enclosed parking spaces shall be provided and maintained in an accessible location on the lot or parcel;" SECTION 8. The minimum number, type and design of parking spaces shall comply with the requirements of Section 18.06.050 of the Anaheim Municipal Code." SECTION 9. That Subsection .020 of Section 18.21.066 of Chapter 18.21, Subsection .020 of Section 18.22.066 of Chapter 18.22, Subsection .020 of Section 18.23.066 of Chapter 18.23, Subsection .020 of Section 18.24.066 of Chapter 18.24, Subsection .020 of Section 18.25.066 of Chapter 18.25, Subsection .020 of Section 18.26.066 of Chapter 18.26, Subsection .020 of Section 18.27.066 of Chapter 18.27, Subsection .020 of Section 18.31.066 of Chapter 18.31, Subsection .020 of Section 18.32.066 of Chapter 18.32, and Subsection .020 of Section 18.34.066 of Chapter 18.34, all of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: "Minimum Dimensions of Parking Spaces. The minimum dimensions of parking spaces shall comply with the requirements of Section 18.06.040 of the Anaheim Municipal Code." SECTION 10. That Subsection .040 of Section 18.21.066 of Chapter 18.21 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".040 Vehicular Access. In order tc ensure adequate circulation and access for pedestrians and for vehicles, and to protect sites from isolation in the course of future development of adjacent open lands, every building site shall abut upon a dedicated street or highway. Dimensions for vehicle accessways shall comply with the requirements of Section 18.06.040 of the Anaheim Municipal Code entitled 'PARKING SPACE AND ACCESS DESIGN.'" -4- SECTION 11. That Subsection .040 of Section 18.22.066 of Chapter 18.22, Subsection .040 of Section 18.23.066 of Chapter 18.23, Subsection .040 of Section 18.24.066 of Chapter 18.24, Subsection .030 of Section 18.25.066 of Chapter 18.25, Subsection .030 of Section 18.26.066 of Chapter 18.26, and Subsection .030 of Section 18.27.066 of Chapter 18.27, all of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: "Vehicle Access Requirements. All vehicle accessways shall comply with the provisions of Section 18.06.040 'PARKING SPACE AND ACCESS DESIGN, except as otherwise set forth in this Chapter." SECTION 12. That Section 18.31.064 of Chapter 18.31 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: "18.31.064 PERMITTED ENCROACHMENTS INTO REQUIRED YARDS. The following structures and items may be permitted to encroach into yards required in this zone subject to compliance with the limitations and conditions for such encroachments prescribed in Section 18.04.043 PERMITTED ENCROACHMENTS INTO REQUIRED YARDS referenced herein: .010 Building connections extending into rear yards. .020 Balconies and exterior stairways. .030 Carports or porte-cocheres. .040 Cornices, eaves, belt courses, sills, buttresses and fireplaces. .050 Fire Escapes. .060 Guardrails. .070 Fences, walls and hedges, in compliance with Section 18.04.043 and as required adjacent to agricultural or one -family residential zones prescribed in this chapter. places." .080 Porches, platforms and landing -5- SECTION 13. That Subsection .052 of Section 18.31.066 of Chapter 18.31, Subsection .062 of Section 18.32.066 of Chapter 18.32, and Subsection .062 of Section 18.34.066 of Chapter 18.34, all of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: "All vehicular parking areas and facilities shall be designed in a manner which precludes vehicles from backing onto public streets." SECTION 14. That Subsection .032 of Section 18.32.062 of Chapter 18.32, and Subsection .032 of Section 18.34.062 of Chapter 18.34, of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".032 In two (2) family and multiple -family dwellings, the floor area per dwelling shall be not less than 550 square feet for bachelor units; provided, however, that the number of bachelor units shall not exceed twenty percent (20%) of the total project. The floor area for one and two bedroom dwellings shall be not less than 700 square feet per dwelling. The floor area for dwellings with three or more bedrooms shall be not less than 825 square feet per dwelling plus not less than 125 square feet for each additional bedroom in excess of three." SECTION 15. That Subsection .020 of Section 18.41.064 of Chapter 18.41, Subsection .010 of Section 18.42.064 of Chapter 18.42 and Subsection .020 of Section 18.44.064 of Chapter 18.44, all of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: "Access Drives and Walks. Entrance and exit drives and walks, not exceeding thirty (30) feet in width, and in compliance with Section 18.06.040 'PARKING SPACE AND ACCESS DESIGN' may be provided into parking areas." SECTION 16. That Subsection .030 of Section 18.41.064 of Chapter 18.41, and Subsection .030 of Section 18.44.064 of Chapter 18.44 of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: -6- ".030 Landscaping, consisting of lawn, trees, shrubs or other natural planting materials, and including fountains, ponds, sculpture, planters, walkways, flagpoles for display of national, state or company ensigns only, light standards and decorative screen type walls, thirty-six (36) inches or less in height, where an integral part of landscaping scheme comprised primarily of plant materials are permitted." SECTION 17. That Subsection .010 of Section 18.41.066 of Chapter 18.41, Subsection .010 of Section 18.42.066 of Chapter 18.42, Subsection .010 of Section 18.44.066 of Chapter 18.44, Subsection .010 of Section 18.61.066 of Chapter 18.61, and Subsection .010 of Section 18.63.066 of Chapter 18.63, all of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: ".010 Location of required parking spaces shall comply with the requirements of Section 18.06.010 'LOCATION OF REQUIRED PARKING SPACES." SECTION 18. That Subsection .020 of Section 18.41.066 of Chapter 18.41, Subsection .020 of Section 18.42.066 of Chapter 18.42, Subsection .020 of Section 18.44.066 of Chapter 18.44, and Subsection .020 of Section 18.48.066 of Chapter 18.48, all of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: ".020 Layout and design of parking areas and vehicle accessways shall comply with the requirements of Section 18.06.020 'LAYOUT AND DESIGN OF PARKING AREAS.'" SECTION 19. That Subsection .030 of Section 18.41.066 of Chapter 18.41, Subsection .030 of Section 18.42.066 of Chapter 18.42, Subsection .030 of Section 18.45.066 of Chapter 18.45, Subsection .030 of Section 18.46.066 of Chapter 18.46, all of Title 18 of the �--. Anaheim Municipal Code be, and the same are hereby, amended to read as follows: ".030 Required improvement of parking areas shall comply with the requirements of Section 18.06.030 'REQUIRED IMPROVEMENT OF PARKING AREAS." -7- SECTION 20. That Subsection .040 of Section 18.41.066 of Chapter 18.41, Subsection .040 of Section 18.42.066 of Chapter 18.42, .. Subsection .040 of Section 18.44.066 of Chapter 18.44, and Subsection .040 of Section 18.48.066 of Chapter 18.48, all of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: ".040 Layout and design of parking areas and vehicle accessways shall comply with the requirements of Section 18.06.040 'PARKING SPACE AND ACCESS DESIGN.'" SECTION 21. That Subsection .070 of Section 18.41.066 of Chapter 18.41, Subsection .070 of Section 18.42.066 of Chapter 18.42, .070 of Section 18.44.066 of Chapter 18.44, Subsection .070 of Section 18.45.066 of Chapter 18.45, and Subsection .070 of Section 18.48.066 of Chapter 18.48, all of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: ".070 Truck loading facilities shall comply with the requirements of Section 18.06.060 'TRUCK LOADING REQUIREMENTS." SECTION 22. That Subsection .021 of Section 18.41.068 of Chapter 18.41, Subsection .021 of Section 18.42.068 of Chapter 18.42, Subsection .021 of Section 18.44.068 of Chapter 18.44, Subsection .021 of Section 18.45.068 of Chapter 18.45, Subsection .021 of Section 18.46.068 of Chapter 18.46, and Subsection .021 of Section 18.48.068 of Chapter 18.48, all of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: ".021 Within any required street setback area, the height of any required wall and/or berm shall be reduced to not more than thirty-six (36) inches." -- SECTION 23. That Subsection .010 of Section 18.41.064 of Chapter 18.41 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".010 _Automobile Parking Areas. Setback areas may be used as part of a surface parking area; provided, however, that a three (3) foot planting strip shall be maintained adjacent to any right-of-way line." -8- SECTION 24. That Section 18.41.066 of Chapter 18.41, Section 18.42.066 of Chapter 18.42, Section 18.44.066 of Chapter 18.44, Section 18.45.066 of Chapter 18.45, Section 18.46.066 of Chapter 18.46, Section 18.48.066 of Chapter 18.48, Section 18.61.066 of Chapter 18.61, and Section 18.63.066 of Chapter 18.63, all of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended by amending the first paragraph of each of said sections to read as follows: "All vehicle accessways and parking and loading areas shall comply with the provisions of Chapter 18.06 'VEHICLE PARKING AND LOADING REQUIREMENTS,' and as provided herein:" SECTION 25. That Subsection .030 of Section 18.44.066 of Chapter 18.44, Subsection .030 of Section 18.61.066 of Chapter 18.61, and Subsection .030 of Section 18.63.066 of Chapter 18.63, of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: ".030 Required Improvement of Parking Areas. All parking areas shall be improved in compliance with Section 18.06.030 'REQUIRED IMPROVEMENT OF PARKING AREAS,' and in accordance with the following:" SECTION 26. That Subsection .010 of Section 18.45.066 of Chapter 18.45, and Subsection .010 of Section 18.46.066 of Chapter 18.46, of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: ".010 Location of required parking spaces shall comply with the provisions of Section 18.06.010 'LOCATION OF REQUIRED PARKING SPACES'; provided further that any property on Anaheim Boulevard or Lincoln Avenue occupied by 'CL' and 'CG' uses on the effective date of this ordinance and on which off-street parking areas are provided in compliance with the requirements of the Planning Commission shall continue to provide such off-street parking facilities, such areas being designated as 'PD -C' PARKING DISTRICT, COMMERCIAL.- -9- SECTION 27. That Subsection .020 of Section 18.45.066 of Chapter 18.45, Subsection .020 of Section 18.46.066 of Chapter 18.46, - Subsection .020 of Section 18.61.066 of Chapter 18.61, and Subsection .020 of Section 18.63.066 of Chapter 18.63, of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: ".020 Minimum dimensions and design of parking areas and vehicle accessways shall comply with the provisions of Section 18.06.020 'LAYOUT AND DESIGN OF PARKING AREAS' and Section 18.06.040 'PARKING SPACE AND ACCESS DESIGN.'" SECTION 28. That Subsection .050 of Section 18.45.066 of Chapter 18.45 and Subsection .050 of Section 18.46.066 of Chapter 18.46, of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: ".050 Required Number and Type of Parking Spaces. The minimum number and type of parking spaces provided for any use in this zone shall be not less than as provided in Section 18.06.050 'MINIMUM NUMBER AND TYPE OF PARKING SPACES'; provided, however, that not less than two-thirds (2/3) of the total site area shall be devoted to public parking area except as otherwise provided in Section 18.06.010 'LOCATION OF REQUIRED PARKING SPACES.'" SECTION 29. That Subsection .040 of Section 18.46.020 of Chapter 18.46 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".040 Automobile sales or rental area or lots (open or enclosed), provided any automobile repair or reconditioning shall be conducted wholly in an enclosed building, and said sales area is located and developed in compliance with Section 18.06.030 'REQUIRED IMPROVEMENT OF PARKING AREAS.'" SECTION 30. That Subsection .030 of Section 18.48.064 of Chapter 18.48 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: -10- ".030 Decorative screen type walls, not exceeding thirty-six (36) inches in height, where located no closer than ten (10) feet from the front property line." SECTION 31. That Subsection .070 of Section 18.48.064 of Chapter 18.48 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".070 Decorative screen walls for the purpose of screening utility devices or facilities, provided such walls shall not exceed thirty-six (36) inches in height within ten (10) feet of the front property line." SECTION 32. That Subsection .010 of Section 18.48.066 of Chapter 18.48 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".010 Location of Required Parking Spaces. All parking areas shall comply with the provisions of Section 18.06.010 'LOCATION OF REQUIRED PARKING AREAS'; provided, however, that parking areas may be permitted to encroach into required setback areas in compliance with the provisions of Section 18.48.064." SECTION 33. That Subsection .030 of Section 18.48.066 of Chapter 18.48 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".030 Required Improvement of Parking Areas. All parking areas shall be improved in compliance with Section 18.06.030 'REQUIRED IMPROVEMENT OF PARKING AREAS'; provided further that the interior portions of all vehicular parking areas shall be planted and maintained with trees at a ratio of at least one (1) tree per each ten thousand (10,000) square feet of parking area. Each tree shall be protected either by means of a minimum four (4) inch high PCC curb or adequate bumper guards." -11- SECTION 34. That Subsection .010 of Section 18.48.064 of Chapter 18.48 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".010 Automobile Parking Areas. When a surface parking area abuts a public street, excepting Harbor Boulevard, Katella Avenue or West Street, the required landscaping area may be reduced to three (3) feet in depth. The required landscaping shall consist of thirty-six (36) inch high screen type shrubs or bushes." SECTION 35. That Section 18.61.063 of Chapter 18.61, and Section 18.63.063 of Chapter 18.63, of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: "STRUCTURAL SETBACK AND YARD REQUIREMENTS. Excepting those areas within the (SC) Scenic Corridor Zone, or within special areas of the City as provided in Section 18.04.045 'REQUIRED SETBACKS IN SPECIAL AREAS,' every building, structure or addition thereto erected in this zone after August 15, 1966, shall be provided with setbacks and landscaping as follows: .010 Front Setback. All properties abutting a public street shall have an open setback area for the full width of the property. This setback shall be parallel to the centerline of the street and shall be measured from the planned highway right-of-way line as designated on the Circulation Element of the General Plan or the ultimate right-of-way line of a local street, and shall be of a depth as indicated below: .011 Abutting any arterial highway; a set back of not less than fifty (50) feet, either fully landscaped or with not less than ten (10) feet parallel with and adjacent to the front property line, landscaped, with the remainder of the required setback area used for parking and/or vehicular circulation. -12- .012 Abutting collector streets or freeway frontage roads; a setback of not less than twenty-five (25) feet, either fully landscaped or with a minimum of ten (10) feet parallel with and adjacent to the front property line, landscaped, with the remainder of the required setback area for parking or vehicular circulation. .013 Abutting local streets and interior streets of industrial subdivisions; a setback of not less than five (5) feet, fully landscaped. .020 Side and Rear Setbacks. None required except where an industrially zoned lot sides or rears upon any residential zone. When this situation exists, the height of any building or structure shall not exceed twenty (20) feet within forty (40) feet of said zone boundary, nor shall be any closer to said zone boundary than the height of the wall or side of that structure. At greater distances than forty (40) feet, but less than two hundred (200) feet from said residential zone boundary, the height of any structure shall not exceed one-half (1/2) of the distance from said structure to such zone boundary. In calculating distance adjoining streets or alleys may be counted. .021 The provision for side and rear yards specified above shall not apply when the industrial property is adjacent to any RS -A-43,000 zoned property upon which a resolution of intent for nonresidential uses has been approved. Side and rear setbacks may be used for parking, storage or other permitted uses subject to all site development standards of this chapter. .030 Service Station Setbacks. Where an automobile service station is established in an industrial zone, the appropriate setback for the street upon which the property has frontage shall apply. Pump islands may be placed within the setback area and may be sheltered by either a separate structure or a sheltering structure attached to the main building. All required landscaping shall be in accordance with adopted service station site development standards. -13- .040 Required Improvement of Setback Areas, Excepting Service Station Setbacks. Any setback herein required shall be improved with landscaping consisting of lawn, trees, shrubs, etc. All landscaped areas shall be permanently maintained in a neat and orderly manner as a condition of use and shall be provided with hose bibbs, sprinklers or similar permanent irrigation facilities. The location of all peripheral and interior landscaping shall be shown on a plot plan and shall be subject to review by the Planning Department. .050 Sidewalk Waivers. In those industrial areas where applicants have been granted temporary sidewalk waivers, the landscaping shall extend to the curb. Any trees shall be located so as not to conflict with potential sidewalks. Plant materials within the public right-of-way, with the exception of trees, shall not exceed thirty-six (36) inches in height." SECTION 36. That Subsection .020 of Section 18.61.064 of Chapter 18.61, and Subsection .020 of Section 18.63.064 of Chapter 18.63, of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: ".020 Decorative screen type walls, not exceeding thirty-six (36) inches in height, where located no closer than ten (10) feet from the front property line along arterial streets and highways, and freeway frontage roads, and no closer than five (5) feet from the front property line along local industrial streets and interior streets of subdivisions." SECTION 37. That Subsection .070 of Section 18.61.066 of Chapter 18.61, and Subsection .070 of Section 18.63.066 of Chapter 18.63, of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: ".070 loading area, in Section 18.06.060 be provided for public alley." Truck Loading Requirements. A truck compliance with the requirements of 'TRUCK LOADING REQUIREMENTS,' shall any site located contiguous to a SlEn SECTION 38. That Subsection .010 of Section 18.81.060 of Chapter 18.81 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".010 When premises are used exclusively for parking purposes, the provisions of Section 18.06.030 'REQUIRED IMPROVEMENT OF PARKING AREAS' and Section 18.06.040 'PARKING SPACE AND ACCESS DESIGN' shall apply." SECTION 39. That Subsection .060 of Section 18.83.062 of Chapter 18.83 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".060 Off -Street Parking. An off-street parking area containing not less than five parking spaces shall be provided for each well being drilled and shall be surfaced and maintained in accordance with the requirements of Chapter 18.06 'VEHICLE PARKING AND LOADING REQUIREMENTS.'" SECTION 40. That Subsection .031 of Section 18.84.052 of Chapter 18.84 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".031 The required fifty feet shall be used for recreation and open space or may be used for open parking and vehicular accessways; provided that a minimum ten foot wide screen planting (may include trees or shrubs, etc., a minimum thirty-six (36) inch high decorative masonry wall, a thirty-six (36) inch high earthen berm, or any combination of these) shall be maintained adjacent to the right-of-way line." SECTION 41. That Subsection .080 of Section 18.87.030 of Chapter 18.87 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: -15- ".080 Walls. Where an interior site boundary line abuts a residential zone, a masonry boundary wall shall be provided having a minimum height of six feet. The wall height shall be measured from the highest finished grade level of subject property or adjacent properties, whichever is highest. Said wall shall be reduced to thirty-six (36) inches in height within any street setback areas for a distance equal to the setback requirement of the adjoining property as measured from the adjacent street right-of-way." SECTION 42. That Subsections .030 of Section 18.88.060 of Chapter 18.88 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".030 Off-street parking shall be provided in accordance with the provisions of Chapter 18.06 'VEHICLE PARKING AND LOADING REQUIREMENTS." SECTION 43. That Subsections .011, .012 and .013 of Section 18.21.066 of Chapter 18.21, Subsections .011, .012 and .013 of Section 18.22.066 of Chapter 18.22, Subsections .011, .012, .013 and .041 of Section 18.23.066 of Chapter 18.23, Subsection .022 of Section 18.24.061 of Chapter 18.24, Subsections .020, .030 and .031 of Section 18.24.064 of Chapter 18.24, Subsections .011, .012 and .013 of Section 18.24.066 of Chapter 18.24, Subsections .011, .012 and .013 of Section 18.25.066 of Chapter 18.25, Subsections .011, .012 and .013 of Section 18.26.066 of Chapter 18.26, Subsections .011, .012 and .013 of Section 18.27.066 of Chapter 18.27, Subsections .021, .022, .030 and .040 of Section 18.31.066 of Chapter 18.31, Subsections .011, .012, .0121, .0122, .0123, .021, .022, .030, .040 and .050 of Section 18.32.066 of Chapter 18.32, Subsections .011, .012, .0121, .0122, .0123, .021, .022, .030, .040 and .050 of Section 18.34.066 of Chapter 18.34, Subsection .031 of Section 18.41.066 of Chapter 18.41, Subsections .031 and .051 of Section 18.42.066 of Chapter 18.42, and Subsections. 011 and .031 of Section 18.48.066 of Chapter 18.48, all of Title 18 of the Anaheim Municipal Code be, and the same are hereby, repealed. -16- SECTION 44. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal hereby of any other ordinance of the City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments. SECTION 45. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 46. CERTIFICATION The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
