4396ORDINANCE NO. 4396 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING SECTION 18.05.074 OF CHAPTER 18.05 OF TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: "18.05.074 FLAGS AND BANNERS. .010 Location. The temporary display of flags and banners for commercial or advertising purposes shall be permitted in any commercial zone or in any zone in conjunction with any use for which a conditional use permit has been issued authorizing a use which is permitted as a matter or right in any of the aforementioned commercial zones; provided, however, that whenever flags and banners are permitted, said flags and banners shall be displayed only after a permit has been issued by the Zoning Division of the Planning Department subject to all of the limitations of this Section. .020 Length of Permit. No permit shall be issued for a period in excess of fourteen consecutive days. .030 Number of Permits. No business shall be issued a permit more than twice each calendar year; provided, further, that nothing contained in this section shall be construed to prohibit the display of the flag of the United States, State of California or other political subdivision, or any flag or banner of any bona fide religious or fraternal organization; provided, however, that no more than three such flags or banners shall be displayed at the same time at any single location within the City. .040 Permit Fee. For each and every permit issued pursuant to this section, there shall be paid to the Zoning Division of the Planning Department a permit fee of such amount as established by Resolution of the City Council. .050 City Council Review. The City Council of the City of Anaheim shall have the power to review any action taken by the Planning Department in denying any application for a permit and shall have the power to revoke a permit granted by the Planning Department if the City Council finds and determines such action on its part is in the public interest, safety or general welfare. The City Council shall also have the power to modify or waive any regulation as specified in this Section with regard to any specific application if it finds and determines such modification or waiver would be in the public interest, safety or general welfare or that extraordinary circumstances are present. When the City Council has acted upon any application for a flag and banner permit, all of the regulations set forth in this Section shall apply unless some regulation set forth therein is expressly waived or modified and, in such event, the regulations shall apply as specified by the City Council in its action. The City Council shall also have the exclusive power to grant a renewal or extension of a permit beyond the original fourteen -day period or to permit more than two such permits each calendar year upon a finding that the same is in the public interest, safety or general welfare or that extraordinary circumstances are present. Any action of the City Council shall be taken in a public meeting, but no notice or public hearing shall be necessary before such action." SECTION 2. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal hereby of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which viola- tions were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal pro- visions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as or- dinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and con- tinuations, and not as new enactments. SECTION 3. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elim- ination herefrom of any such portion as may be declared invalid. SECTION 4. CERTIFICATION The City Clerk shall certify to the passage of this or- dinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
