4421FOLLOWS: repealed. ORDINANCE NO. 4421 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ANAHEIM REPEALING TITLE 4, CHAPTER 4.60 AND ENACTING A NEW TITLE 4, CHAPTER 4.60 OF THE ANAHEIM MUNICIPAL CODE PERTAINING TO PRIVATE PATROLS. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That Title 4, Chapter 4.60 be and the same is hereby SECTION 2. That Title 4, Chapter 4.60 be and the same is hereby added to the Anaheim Municipal Code as follows: "Section 4.60.010 For the purpose of this Chapter, Street Patrol Services and Street Patrol Special Officers shall be those defined by Section 7512 et seq. of the Business and Professions Code of the State of California. Section 4.60.020 STATE REGULATIONS The State of California pursuant to Chapter 11.5, Section 7512 et seq., has preempted local authorities from imposing local regulations on Street Patrol Services and Street Patrol Special Officers as defined in said Business and Professions Code sections except as permitted in Section 7523 of the Business and Professions Code of the State of California. Section 4.60.030 Pursuant to the Authority granted to the City of Anaheim under Section 7523 of the Business and Professions Code of the State of California, the City of Anaheim does require that all Street Patrol Services and Street Patrol Special Officers shall register with the Vice, Narcotics and Organized Crime Division of the Police Department of the City of Anaheim and provide (1) identification; (2) management and ownership information of their street patrol services; and (3) furnish to the Division evidence of current registration with the State of California for all Street Patrol Special Officers as required by Subsection (f) of Section 7514 of the Business and Professions Code of the State of California. Section 4.60.040 There shall be no fee charged by the City of Anaheim for any such registration." SECTION 3. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this chapter of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this chapter independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 4. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments. SECTION 5. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force. That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work, shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer, at the time the property is developed. 2. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 3. That all air conditioning facilities shall be properly shielded from view and shall be in architectural conformance with the structure. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3.
