4436AN ORDINANCE OF TITLE 18 OF THE ING TO ZONING. ORDINANCE NO. 4436 THE CITY OF ANAHEIM AMENDING ANAHEIM MUNICIPAL CODE RELAT- THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the Planning Commission did adopt its Resolution No. PC82-78 determining that a change or changes in the zone or zones hereinafter mentioned and described should be made as hereinafter set forth after a duly noticed hearing; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been complied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the bound- aries of the zones set forth in said Title 18 by adopting a sec- tional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: PARCEL 1: LOT 14 OF TRACT NO. 743, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA AS SHOWN ON A MAP THEREOF RECORDED IN BOOK 22, PAGE 10, MISCELLANEOUS MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY. PARCEL 2: THAT PORTION OF THE EAST ONE-HALF OF THE NORTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 15 IN THE TOWNSHIP 4 SOUTH, RANGE 11 WEST, SAN BERNARDINO BASE AND MERIDIAN, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA DESCRIBED AS FOLLOWS: BEGINNING AT A POINT IN THE NORTHERLY LINE OF TRACT NO. 743, IN THE COUNTY OF ORANGE, STATE OF CALIFORNIA, AS SHOWN ON A MAP THEREOF RECORDED IN BOOK 22, PAGE 10, MISCELLANEOUS MAPS, RECORDS OF SAID ORANGE COUNTY, DISTANT SOUTH 89 DEGREES 39 WEST 314 FEET FROM THE EAST LINE OF SAID SECTION 15; RUNNING THENCE NORTH, PARALLEL WITH THE EAST LINE OF SAID SECTION 15,155 FEET; THENCE SOUTHWESTERLY TO A POINT IN THE WEST LINE OF THE EAST ONE-HALF OF THE NORTHEAST QUARTER OF THE SOUTHEAST -1- 81-82-19 QUARTER OF SAID SECTION 15, DISTANT THEREON 35 FEET NORTH OF THE NORTH LINE OF LOT 15 OF SAID TRACT NO. 743; THENCE SOUTH ALONG SAID WEST LINE, 35 FEET TO THE NORTH LINE OF SAID LOT 15; THENCE NORTH 89 DEGREES 39 MINUTES EAST ALONG THE NORTH LINE OF SAID TRACT NO. 743, 350.61 FEET TO THE POINT OF BEGINNING. EXCEPTING THEREFROM THAT PORTION GRANTED TO JACK BURROUGHS, A MARRIED MAN BY DEED RECORDED DECEMBER 10, 1953, IN BOOK 2631 PAGE 384 OFFICIAL RECORDS, AS INSTRUMENT NO. 84900. ALSO EXCEPT THEREFROM THAT PORTION OF SAID LAND INCLUDED IN THE DEED TO ORANGE COUNTY FLOOD CONTROL DISTRICT RECORDED FEBRUARY 15, 1960 IN BOOK 5097 PAGE 306, OFFICIAL RECORDS, be changed to "RM -3000" RESIDENTIAL, MULTIPLE -FAMILY ZONE, subject to the following conditions: 1. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Executive Director of Public Works. 2. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 3. That subject property shall be served by underground utilities. 4. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 5. That the owner of subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 6. That the original documents of the covenants, conditions, and restrictions, and a letter addressed to developer's title company authorizing recordation thereof, shall be submitted to the City Attorney's Office and approved by the City Attorney's Office, Public Utilities Department, Building Division, and the Engineering Division prior to final tract map approval. Said documents, as approved, shall be filed and recorded in the Office of the Orange County Recorder. 7. That plans for the private street lighting, as required by the standard detail, shall be submitted to the Building Division for approval and inclusion with the building plans prior to the issuance of building permits. (Private streets are those which provide primary access and/or circulation within the project. -2- 8. That if permanent street name signs have not been installed, temporary street name signs shall be installed prior to any occupancy. 9. That the owner(s) of subject property shall pay the traffic signal assessment fee (Ordinance No. 3896) in an amount as determined by the City Council, for each new dwelling unit prior to the issuance of a building permit. 10. That appropriate water assessment fees as determined by the Office of Utilities General Manager shall be paid to the City of Anaheim prior to the issuance of a building permit. 11. That the seller shall provide the purchaser of each condominium unit with written information concerning Anaheim Municipal Code 14.32.500 pertaining to "parking restricted to facilitate street sweeping." Such written information will clearly indicate when on -street parking is prohibited and the penalty for violation. 12. That "no parking for street sweeping" signs shall be installed prior to final street inspection as required by the Public Works Executive Director in accordance with specifications on file with the Street Maintenance Division. 13. That a 6 -foot high masonry wall shall be constructed along the north property line and along the northerly portion of the east property line abutting the RS -A-43,000 Zoned properties. 14. That prior to issuance of building permits, the applicant shall present evidence satisfactory to the Chief Building Inspector that the proposed project is in conformance with Council Policy Number 542, Sound Attenuation in Residential Projects. 15. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 5; provided, however, that the private street driveway from Savanna Street may be a minimum of twenty-five (25) feet wide. 16. That Condition Nos. 1, 3, 4, 13 and 15, above-mentioned, shall be complied with prior to final building and zoning inspections. SECTION 2. The City Zoning Map shall be, and the amended and the property above-described shall be zone in which it is now situated and incorporated of the zone or zones as above set forth, and said amended, is hereby adopted and the City Engineer to prepare a sectional zoning map to be added to showing the changes hereby approved and adopted. -4- same is hereby, excluded from the in and made a part City Zoning Map, as is hereby directed the City Zoning Map SECTION 3. CERTIFICATION The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fif- teen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circula- ted in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force. THE FOREGOING ORDINANCE is approved and adopted by the City Council of the City of Anaheim this 31st day of May, 1983.
